CHAPTER 216
An Act to provide a charter for the Town of Manassas Park in Prince
William County; and to repeal the existing charter of the foun H 9
Approved March 9, 1962
Be it enacted by the General Assembly of Virginia as follows:
1. § 1. The inhabitants of the territory comprised within the limits of
the Town of Manassas Park, as such limits are hereinafter set out or as
the same may be hereinafter altered and established by law, shall consti-
tute and continue a body, politic and corporate, to be known and desig-
nated as the Town of Manassas Park, and as such shall have and may
exercise all powers which are now or hereafter may be conferred upon or
delegated to the Town under the Constitution and laws of the Common-
wealth of Virginia, as fully and completely as though such powers were
specifically enumerated herein, and no enumeration of the particular
powers by this charter shall be held to be exclusive, and it shall have,
exercise and enjoy all the rights, immunities, powers, and privileges and
be subject to all the duties and obligations now appertaining to and incum-
bent on said town as a municipal corporation, and shall have perpetual
succession, may sue and be sued, implead and be impleaded, contract and
be contracted with, and may have a corporate seal which it may alter,
renew, or amend at its pleasure by proper ordinance.
§ 2. Corporate Limits. The boundaries of the Town of Manassas
Park, Prince William County, Virginia, shall be and remain as now estab-
lished, but the boundaries thereof are incorporated herein by reference to
the recordation in the Clerk’s Office of the Circuit Court of Prince William
County, Virginia, the Court where deeds are admitted to record, of the
final decree or order of the Court establishing such boundaries which final
decree or order was entered on the twenty-first day of January, nineteen
hundred fifty-seven, in the said Clerk’s Office in Common Law Order Book
17, Page 429.
§ 8. Powers. The powers set forth in Title 15, Sections 15-77.2,
15-77.8, 15-77.4, 15-77.5, 15-77.6, 15-77.7, 15-77.8, 15-77.9, 15-77.10,
15-77.11, 15-77.12, 15-77.13, 15-77.14, 15-77.15, 15-77.16, 15-77.17, 15-77.18,
15-77.19, 15-77.20, 15-77.21, 15-77.22, 15-77.23, 15-77.24, 15-77.25, 15-77.26,
15-77.27, 15-77.28, 15-77.29, 15-77.30, 15-77.31, 15-77.32, 15-77.33, 15-77.34,
15-77.35, 15-77.36, 15-77.37, 15-77.38, 15-77.39, 15-77.40, 15-77.41, 15-77.42,
15-77.48, 15-77.44, 15-77.45, 15-77.46, 15-77.47, 15-77.48, 15-77.49, 15-77.50,
15-77.51, 15-77.52, 15-77.58, 15-77.54, 15-77.55, 15-77.56, 15-77.57, 15-77.58,
15-77.59, 15-77.60, 15-77.61, 15-77.62, 15-77.63, 15-77.64, 15-77.65, 15-77.66,
15-77.67, 15-77.68, 15-77.69, 15-77.70 of Title 15, Chapter 5.1 of the Code
of Virginia as in force on January one, nineteen hundred sixty-one, are
hereby specifically conferred upon the Town of Manassas Park as provided
in and pursuant to the provisions of said Chapter of the 1950 Code of
Virginia as amended.
§ 4. Administration and Government. The government of said
town shall be vested in a town council, which shall be composed of a mayor
and six councilmen.
(a) On the second Tuesday in June, nineteen hundred and sixty-two,
there shall be elected by the qualified voters of the Town of Manassas
Park, at a special election two councilmen who shall serve until August
thirty-one, nineteen hundred sixty-three, or until their duly elected succes-
sors shall have qualified.
(b) On the second Tuesday in June, nineteen hundred and sixty-three,
there shall be elected by the qualified voters of the Town of Manassas Park,
six councilmen. Of the candidates to the council, the candidate receiving
the highest number of votes, the candidate receiving the second highest
number of votes, and the candidate receiving the third highest number of
votes at this election for the office of councilman shall hold office for a
term of four years from the first day of September, following the date of
their election and until their duly elected successors shall have qualified.
The candidate receiving the fourth highest number of votes, the candidate
receiving the fifth highest number of votes and the candidate receiving
the sixth highest number of votes at this election for the office of council-
man shall hold office for a term of two years from the first day of Septem-
ber following the date of this election and until their duly elected succes-
sors shall have qualified. On the second Tuesday in June, nineteen hundred
sixty-five, and every two years thereafter, there shall be elected by the
qualified voters of the town, three councilmen qualified as aforesaid, who
shall hold office for terms of four years from the first day of September
following the date of their election and until their duly elected successors
shall have qualified.
On the second Tuesday in June, nineteen hundred sixty-three, and
every four years thereafter, there shall be elected by the qualified voters
of the Town of Manassas Park, a mayor, who shall be qualified as afore-
said, and whose term of office shall begin on the first day of September
following the date of his election and continue for four years thereafter,
and until his duly elected successor shall have qualified.
The council may fill any vacancy that may occur in the membership
of the town council for any unexpired term from the roles of those
qualified.
The mayor and each member of the council may receive a salary to be
fixed by the council not exceeding nine hundred dollars per person per
annum, payable at such time and in such manner as the council may direct.
§ 5. Officers and Employees formerly elected or appointed. All
town officers and employees heretofore elected or appointed shall remain
in office and continue in their employment and be vested with the powers
and duties heretofore imposed upon them by the council or by operation of
law or hereafter imposed upon them under the provisions of this act until
their successors are duly elected or appointed as provided by law or until
action is taken by the town as set forth in Section 15-77.9 of Chapter 5.1
of Title 15 of the 1950 Code of Virginia as in force on January one, nine-
teen hundred sixty-one.
§ 6. Ordinances Continued. All ordinances and resolutions hereto-
fore made and adopted by the Town, not in conflict with this charter shall
be and remain in full force and effect until altered, amended or repealed
by the council of the town.
§ 7. Town court of limited jurisdiction. The council may appoint
a police justice for the town pursuant to Chapter 5, Title 16.1 of the Code
of Virginia as amended. The Mayor, or any other qualified voter of the
Town of Manassas Park, whom the council deems qualified, may be ap-
pointed by it as such judge. If the mayor is appointed judge he shall
discharge such duties as the judge of the town under this charter and not
as the mayor of the town, in addition to the execution of the duties of the
mayor imposed upon him by this charter; and his powers, duties, authority
and jurisdiction as such police justice shall be as hereinafter provided,
he shall receive the salary of Mayor provided by the council for the dis-
charge of his duties as mayor as well as such salary of police Justice as
may be provided by the council, if any.
The police justice is hereby vested with all the power, authority and
jurisdiction and charged with all the duties within and for the Town of
Manassas Park, and for one mile beyond the corporate limits thereof as
set forth in Chapter 5 of Title 16.1 of the 1950 Code of Virginia as
amended and any amendments of the laws of the State respecting courts
of limited jurisdiction referred to in said chapter shall also be considered
pureneinents of this section of this charter if the same are applicable
ereto.
Fees and costs shall be assessed by the police justice and shall be
collected as provided by the laws of the State of Virginia relating to courts
not of record as the same shall now be or as hereafter amended. All fees
and costs collected by the said police justice and all fines collected for
violations of all laws and ordinances of the town shall be paid into the
town treasury for the use and benefit of the town.
Removals may be taken, and appeals from the decisions of the judge
may be taken, to the Circuit Court of Prince William County in the manner
provided under Chapter 5, of Title 16.1 of the 1950 Code of Virginia as
amended.
The council may also appoint such clerks as may in their discretion
be necessary, provide for just compensation therefor and provide necessary
records.
The council of said town shall provide a salary to compensate such
police justice in such amount and payable at such times as the council
shall deem proper, and the council may provide also for a vacation period,
either with or without pay, and for such duration, as in the judgment of
the council may be proper.
Like provisions may be made for a substitute judge, and when such
substitute acts, he shall receive the compensation which would have been
paid the principal had the principal acted, and which compensation shall be
deducted from the salary or allowance made for the principal.
The Town of Manassas Park may combine with the County of Prince
William for the use of one judge and one substitute judge for such combined
town and county, in such manner as may be provided by the laws of the
State of Virginia relating to courts not of record; and if the Town of
Manassas Park and the County of Prince William shall at any time combine
for the use of one judge and one substitute judge for the said town and
the said county, the laws of the State of Virginia relating to courts not of
record, so far as applicable, shall control and not this section of this charter.
§ 8. Town Jail. The Town of Manassas Park may purchase, con-
struct, rent or contract for the use of such buildings as are appropriate
for use as a jail or may have use of the Prince William County jail whose
Jailer shall receive and keep all persons duly committed by the proper
officers of the Town of Manassas Park, and he shall be paid for the board
la prisoners by the treasurer at like rates as other prisoners in such
Jail.
§ 9. Town Hall. The Town of Manassas Park may purchase, con-
struct, rent or contract for the use of such buildings as are appropriate
for use as a town hall or the mayor and the town council of Manassas Park
may have the use of the county court house at Prince William County as
their own town hall for the transaction of official business, when the same
is not otherwise occupied and used by the Circuit Court, the judges thereof,
the Board of Supervisors, or for other county purposes, which privilege
shall in no manner lessen the authority or control over the said court house
building, as by law established by the Circuit Court and the Board of
Supervisors. Such designation of the County Court house of Prince William
County at Manassas as the town hall of the Town of Manassas Park shall
not be construed to prevent the council of the Town of Manassas Park
from holding its meetings, regular or special, at any other place or places
as they may by resolution provide.
2. Should any section of this charter be declared by a court of competent
jurisdiction to be invalid, such decision shall not affect the validity of this
charter as a whole or any other part thereof.
3. The charter of the Town of Manassas Park heretofore granted is
repealed.
4. An emergency exists and this act is in force from its passage.
