CHAPTER 186
An Act to amend and reenact § 53-293, as amended, of the Code of
Virginia, relating to penalties prescribed for offenses committed by
convicts.

Be it enacted by the General Assembly of Virginia:
1. That § 53-293, as amended, of the Code of Virginia, be amended and
reenacted as follows:
§ 53-293. A convict guilty of such killing as is mentioned in § 53-291,
or of any act therein mentioned, from which death ensues to such officer or
guard, shall be punished with death. If the officer or guard be injured and
death not ensue, then the convict shall be punished as provided in § 18.1-65.
For any other offense mentioned in either of the two preceding sections, a
convict shall be confined in the penitentiary not less than one nor more than
five years after the end of the term for which he shall then be subject to
confinement.
