An Act to amend the Code of Virginia by adding a section numbered
4-112.2, to provide for the issuance of certain identification cards to
persons entitled to purchase certain beverages and to provide for the
cost thereof, to provide for the signing of statements by nonresidents
to induce licensees of the Virginia Alcoholic Beverage Control Board
to sell certain beverages, to provide for the keeping of such state-
ments, and to provide penalties for false representations. rH 419]

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding a section num-
bered 4-112.2, as follows:
§ 4-112.2. (a) Upon application of any person who is a resident of
this State, who is eighteen years of age or older but not more than twenty-
five years of age, and who is a person to whom beverages may lawfully be
sold, the clerk of the circuit court of the county or of the corporation or
circuit court, as the case may be, of the city wherein such person resides,
shall cause a certificate to be issued to such person for the purpose of
identification in connection with the purchase of beverages by such person.
The application shall be in such form as may be prescribed by the Virginia
Alcoholic Beverage Control Board and shall be accompanied by a photo-
graph of the applicant. Every such certificate shall be in such form as
may be prescribed by the Virginia Alcoholic Beverage Control Board and
shall contain the name, address, weight, sex, race, height, color of eyes,
date of birth, place of birth and signature, together with a photograph of
the person to whom it is to be issued. With every such application there
shall be paid to the clerk of the court a fee of one dollar and fifty cents.
The failure of a person to present a certificate issued pursuant to this
section upon demand of an employee of a retail establishment licensed by
the Board who has reason to believe such person is less than eighteen
years of age shall be cause for the refusal by such an employee to sell
beverages to such person.
(b) A person who is not a resident of this State but who is a person
to whom beverages may lawfully be sold and whose age has been ques-
tioned by an employee of a retail establishment licensed by the Board in
the connection with the purchase of a beverage may execute a statement
and sign same on the following form in the presence of two competent wit-
nesses who are twenty-one years of age or older and are not employed in
a retail establishment licensed by the Board:

I represent further that this statement is made to induce the lcensee
named above to sell or otherwise furnish a beverage to the undersigned
and I understand that I am subject to the punishment provided by law
for any false representation made herein.

The foregoing statement shall be printed upon a card three inches by five
inches in size to be furnished by the vendor of beverages who shall file
same with other such statements at or before the close of business on the
day on which the statement was executed in a file box containing a suit-
able alphabetical index and each such card shall be kept available for a
period of one year from the date of issuance for inspection by law enforce-
ment officers and agents of the Board at all times during business hours.
Any statement submitted in accordance with the foregoing shall be
admissible in any proceeding commenced against a vendor of beverages
alleging the unlawful sale of beverages to the person who has executed
such statement. ;
(c) Any person convicted of falsely representing any material fact
in applying to the Board for a certificate as provided for in subsection (a)
of this section or in executing a statement as provided for in subsection (b)
of this section shall be guilty of a misdemeanor.
