An Act for the relief of James S. Nicholas.

Whereas, on September 1, 1954, James S. Nicholas was an attendant
at the Lynchburg Training School and Hospital, situate at Colony, in
Amherst County, Virginia; and
Whereas, in the course of his duties as an attendant at said hospital,
it became his duty to nurse a patient ill with encephalitis; and
Whereas, as a result of his duties in nursing said patient, James S.
Nicholas contracted encephalitis, as a result of which he was put to great
expense for medical and hospital bills; and
Whereas, as a further result of his disease, he was incapacitated for
future work and his mind, nervous system and body have been so affected
that he cannot work any more; and
Whereas, no workmen’s compensation or other benefits were paid to
James S. Nicholas, although he was entitled to the same, and when he had
recovered his faculties sufficiently to realize that he did have a claim the
statute of limitations had run thereon; and
Whereas, correspondence in the file on James S. Nicholas at the Lynch-
burg Training School and Hospital has been lost and cannot be located; and
Whereas, James S. Nicholas is without a remedy at law and is unable
to apply to the Industrial Commission for relief; and
Whereas, the General Assembly is of the opinion that this case should
be passed upon by the Industrial Commission; now, therefore,
Be it enacted by the General Assembly of Virginia:
1. That the statute of limitations set out in the Workmen’s Compensa-
tion Act be hereby waived so that an adjudication of the merits of this
case may be had.
