CHAPTER 471
An Act to authorize the Governor and Attorney General to execute, in
the name of the Commonwealth, a deed conveying unto the United
States of America certain formerly submerged lands in Willoughby
Bay, Mason Creek, Theleball’s Creek and Boush Creek in the city
of Norfolk, Virginia.

Whereas, between the years 1940 and 1943, the United States of
America, reclaimed, by filling, certain submerged lands from the beds of
Willoughby Bay, Mason Creek, Theleball’s Creek and Boush Creek, abut-
ting on the property of the United States of America, and erected therein
airplane runways, taxiways, buildings and other permanent improvements
for the operation, landing and repair of naval aircraft, all in the interest
of the national defense; and
Whereas, the United States now desires to perfect its title to the said
reclaimed lands by obtaining a conveyance thereof from the Common-
wealth of Virginia; and
Whereas, it is in the public interest that the Commonwealth of Vir-
ginia so convey its title to such reclaimed lands to the United States of
America, subject to the jurisdictional and other limitations and reserva-
tions contained in § 7-19 of the Code of Virginia of 1950, as amended,
notwithstanding anything to the contrary contained in § 7-25 of the
Code of Virginia of 1950, as amended; now, therefore,
Be it enacted by the General Assembly of Virginia:
1. The Governor and the Attorney General are hereby authorized in
consideration of the premises and of the payment of the sum of ONE
DOLLAR ($1.00) to the Commonwealth of Virginia by the United States
of America, to execute, in the name of the Commonwealth of Virginia, and
deliver to the United States of America, a proper deed of conveyance,
under the lesser seal of the Commonwealth, conveying forever, subject
only to the jurisdictional and other limitations and reservations contained
in § 7-19 of the Code of Virginia of 1950, as amended, notwithstanding
anything to the contrary contained in § 7-25 of the Code of Virginia of
1950, as amended, all of its right, title and interest in and to the following
described property:
All those four certain tracts, pieces, or parcels of formerly submerged
land lying and being in the city of Norfolk, Virginia, abutting on the prop-
erty of the United States of America, and being more particularly de-
scribed as follows, to-wit:
FIRST: Starting at a point in the easterly line of Taussig Boulevard
(formerly Kersloe Road) said point being a corner common to cts
“B” and “D” acquired by Declaration of Taking filed July 11, 1940, in the
District Court of the United States, Eastern District, Virginia, in an
action entitled, “United States of America, Petitioner, v. 1034 acres, more
or less, of land in the City of Norfolk and County of Norfolk, State of
Virginia, et al., Defendants,”; thence with the boundary line separating
these tracts N 6° 48’ E 559 feet, S 87° 34’ E 230.7 feet, S 86° 54” E 300
feet, and N 8° 00’ W 660 feet to the POINT OF BEGINNING, thence
northward with the easterly boundary of said Tract ‘‘D” to its intersection
with the northerly line of Mason Creek Bridge, said boundary being the
former mean low water line of Theleball’s Creek and Mason Creek as it
existed in July 1940; thence with the northerly edge of Mason Creek
Bridge N 39° 50’ E 550 feet to its intersection with the westerly boundary
of Tract “A” acquired in the above mentioned Declaration of Taking;
thence generally, easterly, southerly, easterly, southwesterly and south-
easterly with the boundary of said Tract “A” to its intersection with
the present mean low water line of Mason Creek, the aforesaid boundary
of Tract “A” being the mean low water line of former Mason Creek as it
existed in July 1940; thence with existing mean low water line of Mason
Creek S 36° 00’ E 1295 feet to its intersection with the northerly boundary
of Tract “B” mentioned aforesaid, thence westerly and southerly with the
boundary of Tract “B” to the POINT OF BEGINNING, said boundary
being the former mean low water line of Mason Creek and Theleball’s
Creek as it existed in July 1940, containing 131. 6 acres, more or less, and
being more particularly shown on Y & D DRAWING No. 842786 entitled,
“Naval Air Station, Norfolk, Va., Property Map showing reclaimed area
to be acquired from the Commonwealth of Virginia,” dated December 14,
1959, as Reclaimed Area No. 1,
SECOND: Beginning at a point in the northerly boundary of former
99th Street acquired as Tract “F” by Declaration of Taking filed October
9, 1940, in the District Court of the United States, Eastern District, Vir-
ginia, in an action entitled, “United States of America, Petitioner, v. 7.1
acres of land, more or less, in the City and County of Norfolk, Virginia,
et al., Defendants”, said point being the southeasterly corner of the lands
acquired by the United States of America by Presidential Proclamation
signed June 28, 1917, and recorded in the Clerk’s Office of the Circuit
Court of Norfolk County, Virginia, September 22, 1917, Deed Book 440
at Page 417, which said lands were then known as the “Jamestown Exposi-
tion Site on Hampton Roads, Virginia”, thence with the boundary of said
Jamestown Exposition Site to a corner in a 374 acre parcel acquired by
deed from the Commonwealth of Virginia to the United States of America
dated March 8, 1956, recorded in the Clerk’s Office of the Circuit Court,
Norfolk County, March 15, 1956, Deed Book 1206 at Page 226, recorded
in the Clerk’s Office of the Corporation Court of the City of Norfolk,
Virginia, March 30, 1956, Deed Book 721 at Page 228, the aforementioned
Jamestown Tract boundary being the former mean low water line of the
main channel of Boush Creek as it existed in June 1917, and having the
following approximate courses and distances N 16° 00’ E 650 feet N 38°
00’ W 1030 feet; N 39° 00” E 400 feet; S 68° 00 E 1840 feet; thence with
the boundary of the aforesaid 374 acre parcel S 67° 21’ E 620 feet to its
intersection with the easterly edge of an existing bulkhead, thence with
the said edge of bulkhead S 28° 00” W 240 feet to its intersection with
the boundary of lands acquired as Tract “D’’ by Declaration of Taking
filed July 11, 1940 in the District Court of the United States, Eastern
District, Virginia, in an action entitled, “United States of America, Peti-
tioner, v. 1034 acres, more or less of land in the City of Norfolk and
County of Norfolk, State of Virginia, et al., Defendants”; thence with
the boundary of said Tract “D” generally westerly and southerly to the
northeasterly corner of lands acquired as Tract “F” in the Declaration
of Taking first above mentioned, said boundary of Tract “D” being the
mean low water line of Boush Creek as it existed in July 1940; thence
with the boundary of said Tract “F” N 84° 00’ W 260 feet to the POINT
OF BEGINNING containing 28.8 acres, more or less, and being more par-
ticularly shown on Y & D Drawing No. 842786 entitled, “Naval Air Sta-
tion, Norfolk, Va., Property Map showing reclaimed areas to be acquired
from the Commonwealth of Virginia”, dated December 14, 1959, as Re-
claimed Area No. 2.
THIRD: Starting at the intersection of the northerly edge of Mason
Creek Bridge with the westerly edge of an existing bulkhead, thence with
said edge of bulkhead N 47° 56 W 160 feet to an intersection with the
boundary of Tract “A” acquired by Declaration of Taking filed July 11,
1940, in the District Court of the United States, Eastern District, Virginia,
in an action entitled, “United States of America, Petitioner, v. 1034 acres,
more or less, of land in the City of Norfolk and County of Norfolk, State
of Virginia, et al., Defendants”, said intersection being the POINT OF
BEGINNING for Reclaimed Area No. 3; thence with said edge of bulkhead
N 47° 56’ W 430 feet to another intersection with the boundary of said
Tract “A”, thence with the boundary of Tract “A” generally northerly,
easterly and southerly to the POINT OF BEGINNING, said boundary
being the former mean low water line of Mason Creek as it existed in
July 1940, containing 2.6 acres, more or less, and being more particularly
shown on Y & D Drawing No. 842786 entitled, “Naval Air Station, Nor-
folk, Va., Property Map Showing Reclaimed Areas to be acquired from
the Commonwealth of Virginia’, dated December 14, 1959, as Reclaimed
Area No. 3.
FOURTH: Beginning at a point, said point being the northwest
corner of lands acquired by Declaration of Taking filed April 9, 1942, in
the District Court of the United States, Eastern District, Virginia, in an
action entitled, “United States of America, Petitioner, v. certain lots,
blocks and tracts of land in the City of Norfolk, Virginia, John A. Morris,
et al., Defendants”, said point also being the northeast corner of lands
acquired by Declaration of Taking filed November 5, 1941, in the District
Court of the United States, Eastern District, Virginia, in an action en-
titled, “United States of America, Petitioner, v. 87.47 acres of land, more
or less, in Norfolk County, Virginia, Will-Cooke corp., et al., Defend-
ants’; thence with the boundary of land acquired in the last mentioned
Declaration of Taking S 73° 17’ W 700 feet to its intersection with the
westerly edge of an existing bulkhead, said boundary being the former
mean low water line of Willoughby Bay as it existed in November 1941,
thence with the said westerly edge of the bulkhead N 19° 45’ W 20 feet
to a corner in said bulkhead, thence with the northerly edge of said bulk-
head N 70° 15’ E 210 feet to its intersection with the present mean low
water line of Willoughby Bay, thence with the present mean low water
line of Willoughby Bay the following courses and distances N 22° 30°
E 285 feet; N 5° 58’ W 700 feet; N 39° 10’ W 200 feet; N 17° 00” W 170
feet; N 2° 00’ W 550 feet; N 3° 50’ W 680 feet; N 1° 58’ E 710 feet; N 25°
30’ E 680 feet; N 75° 28’ E 585 feet; S 63° 10’ E 640 feet, S 55° 50’ E 795
feet; S 84° 00’ E 215 feet to its intersection with the boundary of lands
acquired in the first mentioned Declaration of Taking, said intersection
being located S 20° 25’ 48” E 801.29 feet from an iron pin in the northeast
corner of West Ocean View Avenue and 6th View Street, thence with the
boundary of lands acquired in the first mentioned Declaration of Taking
southerly and westerly to the POINT OF BEGINNING, said boundary
being the former mean low water line of Willoughby Bay as it existed in
April 1942, containing 188.86 acres, more or less, and being more par-
ticularly shown on Y & D Drawing No. 842786 entitled, ““Naval Air Sta-
tion, Norfolk, Va., Property Map Showing Reclaimed Areas to be ac-
quired from the Commonwealth of Virginia”, dated December 14, 1959,
as Reclaimed Area No. 4.
2. An emergency exists and this act is in force from its passage.
