[S 140]
Approved March 31, 1960
Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding a section numbered
26-20.1, as follows:
§ 26-20.1. In lieu of the settlement of accounts required by § 26-17,
the personal representative of a decedent who is also the sole distributee
of the estate or sole beneficiary of the will of decedent may file with the
commissioner of accounts a statement under oath that he has paid all
known charges against the estate and, after the time required by law,
delivered the residue of the estate to himself as such distributee or bene-
ficiary. If there be a will under which an executor or administrator with
the will annexed is the sole residuary legatee, a similar statement may be
filed by him if accompanied by proper vouchers showing satisfaction of all
other bequests in the will. Such statement shall be considered an account
stated and subject to all the provisions of Chapter 2 of Title 26 of the
1950 Code of Virginia as amended applicable to accounts stated.
