CHAPTER 334
An Act to amend and reenact §§ 54-807 as amended, 54-808 as amended,
54-808.5, 54-810 as amended, and 54-310.1, of the Code of Virginia,
relating respectively to fees for examinations in the healing arts,
requirements for admission to examination on chiropody, requirements
for admission to examination on physical therapy, the issuance of
certificates to practice the healing arts to applicants from without the
state, and the issuance of certificates to practice physical therapy to
certain applicants without examination. 'S 180)

Be it enacted by the General Assembly of Virginia:
1. That §§ 54-307 as amended, 54-308 as amended, 54-308.5, 54-310 as
amended, and 54-310.1 of the Code of Virginia, be amended and reenacted,
as follows:
§ 54-307. The fee for each Part I examination given shall be * twenty-
five dollars *, and the fee for each Part II examination given shall be
* twenty-five dollars *. In the event the candidate is admitted to the Part IT
examination without being required to take the Part I examination, the fee
for the Part II examination shall be * fifty dollars. No examination shall
be taken until the fee prescribed therefor has been paid.
If a candidate whose credentials have been processed and accepted
by the Board fails for any reason to take the examination for which he
has applied, the Board shall retain the sum of ten dollars and refund to the
candidate the remainder of the fee paid. If a candidate applies for Part I
and Part II examinations and takes the Part I examination but does not
pass it or for any reason fails to take the Part II examination, the Board
shall refund to him the entire fee paid by him for the Part II examination.
§ 54-308. Examinations of applicants to practice chiropody shall be in
one part, and shall include the subjects named in § 54-301. Each candidate
must submit evidence, verified by affidavit and satisfactory to the Board,
that he or she:
(a) Is twenty-one years of age or more.
(b) Is of good moral character.
(c) Is a graduate of an accredited high school, or has completed the
full equivalent of a grammar school and a four-year high school course.
(d) Has completed successfully at least a two-year academic course
in an accredited college.
(e) Is a graduate of a recognized school of chiropody (podiatry)
having a minimum requirement for graduation of four school years in
attendance, which school at the time of such attendance maintained stand-
ards which qualified it for inclusion on the list of approved schools pre-
pared by the National Association of Chiropodists.
The fee for the examination of chiropody shall be * fifty dollars.
§ 54-308.5. Examinations of applicants to practice physical therapy
shall be in one part, and shall include the subjects in § 54-301.1. Each
candidate must submit evidence, verified by affidavit and satisfactory to
the Board, that he or she:
(a) Is a citizen of the United States, or if not a citizen, has filed a
declaration of intention to become a citizen of the United States;
(b) Is twenty years of age or more;
(c) Is of good moral character;
(d) Is a graduate of an accredited high school, or has completed the
full equivalent of a grammar school and a four year high school course;
(e) Is a graduate of a school of physical therapy approved by the
Council on Medical Education and Hospitals of the American Medical
Association or by the American Physical Therapy Association, or is a
graduate of a school outside of the United States or Canada which offers
and requires courses in physical therapy acceptable to the Board on the
advice of the Committee. The fee for the examination of physical thera-
pists shall be * thirty dollars.
§ 54-310. The Board may, in its discretion, arrange for reciprocity with
the authorities of the District of Columbia and other states and territories
having requirements equal to those established by this chapter, and issue
certificates to applicants who have met such requirements. The Board
may, in its discretion, issue certificates to applicants upon endorsement
by boards or other appropriate authorities of other states or territories or
the District of Columbia with which reciprocal relations have not been
established and to applicants holding certificates from the National Board
of Medical Examiners, provided the credentials of the applicants are
satisfactory and their schools of graduation and the examinations and
passing grades required by such other boards are fully equal to those
required by the Virginia Board.
An applicant for a certificate or license to practice physical therapy
through reciprocity shall be a citizen of the United States, or if not a
citizen, must have filed a declaration of intention to become a citizen of
the United States.
The fee for any such certificate, other than for the practice of physical
therapy, shall be one hundred dollars, and the fee for a certificate to
practice physical therapy shall be thirty dollars. The required fee shall
be paid to the secretary of the Board before the certificate is granted,
but if the Board fails or refuses to grant the certificate after the creden-
tials of the applicant have been processed, the Board shall retain the sum
of ten dollars and refund the remainder of the fee to the candidate.
An applicant for a certificate of endorsement from the Board to
another state or territory or the District of Columbia shall pay to the Board
a fee of ten dollars which shall not be refunded.
§ 54-310.1. The Board shall grant a certificate or license to practice
physical therapy without examination to any person who:
(a) Applies for such license or certificate by March one, nineteen
hundred fifty-nine or, who, if serving in the armed forces of the United
States of America on June 27, 1958, applies for registration within six
months after discharge, separation or release from the Armed Forces;
(b) On June 27, 1958, has met the requirements listed in paragraphs
(a), (b), (c), and (d) of § 54-308.5;
(c) Is practicing physical therapy, as defined and limited in this
chapter, full time in the State of Virginia and was so practicing on and
for at least one year prior to June 27, 1958, or the date of his application,
or, if serving in the Armed Forces on June 27, 1958, was practicing full
hime in the State of Virginia for at least one year prior to June 27, 1958;
an
(d) At the time of making such application pays a fee of * thirty
dollars to the Board.
2. An emergency exists and this act is in force from its passage.
