CHAPTER 261
An Act to provide a new charter for the town of Colonial Beach, and to
repeal Chapter 878 of the Acts of Assembly of 1892, approved Febru-
ary 25, 1892, which incorporated such town and all amendments
thereof.

Be it enacted by the General Assembly of Virginia:
§ 1. That Colonial Beach, in the county of Westmoreland, shall con-
stitute and continue a body politic and corporate.
2. The boundaries of said town shall be as set forth in Chap 378
of the Acts of Assembly of 1892 and as enlarged by order of the circuit
court of Westmoreland County, duly entered in Common Law Order Book
6, at page 392, and duly recorded in the Clerk’s Office of Westmoreland
County, Virginia, in Deed Book 169, at pages 319 and 320.
§ 3. The administration and government of the town shall be vested
in a council, composed of a mayor and six councilmen, all of whom shall be
qualified electors of the town and all of whom shall be elected pursuant to
the provisions of §§ 24-168 through 24-175 of the Code of Virginia. The
town shall also have a treasurer, who shall be elected by the qualified
voters of the town and whose election and term of office shall be coincident
with that of the mayor and councilmen.
§ 4. The council may appoint a clerk, a town sergeant, a town attor-
ney and such other officers, and may create such other boards and de-
partments as it deems necessary or proper, and define their duties and
functions. Such officers, boards and departments so appointed shall
hold office during the pleasure of the council; shall give bond as the
council requires; and shall receive such compensation as the council
prescribes.
§ 5. The council may appoint a police justice for the town, who shall
give such bond as the council requires and shall receive such compensa-
tion as the council prescribes. Such police justice shall have during such
time as he serves the same powers as are conferred by law upon police
justices for towns of this State including original exclusive jurisdiction
to try cases involving violations of town ordinances, and shall have like
powers in the matter of collecting fines and costs imposed by him as are
vested by law in the judges of county courts. The mayor of the town
shall be eligible for the office of police justice. The police justice shall
hold his office for a period of two years or until his successor is appointed
and qualified.
§ 6. The special school district of the town of Colonial Beach as is
now provided by law under § 22-43 of the Code of Virginia shall be and
is hereby continued.
§ 7. The powers set forth in §§ 15-77.2 through 15-77.70 of the Code
of Virginia as in force on the twenty-seventh day of June, nineteen hun-
dred fifty-eight, are hereby conferred on and vested in the town of
Colonial Beach.
§ 8. All ordinances now in force in the town of Colonial Beach not
inconsistent with this charter shall be and remain in full force and effect
until altered, amended or repealed by the council of the town after the
effective date of this act.
2. Chapter 373 of the Acts of Assembly of 1892, approved February 25,
1892, and all amendments thereto are repealed.
3. An emergency exists and this act is in force from its passage.
