An Act to authorize, subject to certain conditions, the Board of Visitors
of the College of William and Mary in Virginia to sell and convey
certain property in the city of Williamsburg and county of James
City to Colonial Williamsburg, Incorporated.

Whereas, by deed dated September 5, 1945, the Commonwealth of
Virginia, the State Hospital Board and Eastern State Hospital conveyed
to the College of William and Mary in Virginia certain real estate lying
partly within the corporate limits of the City of Williamsburg and partly
within the County of James City, comprising approximately 207 acres
with improvements thereon, which deed was recorded in the Clerk’s
Office of the Circuit Court of the City of Williamsburg in James City
County on September 11, 1945, in Deed Book 20, page 298; and
Whereas, the Board of Visitors of the College of William and Mary
in Virginia desires to make an exception to its general policy of retaining
College land in order that important restoration and reconstruction work
may be carried on in this historic area of the City of Wilhiamsburg and
the County of James City; and
Whereas, Colonial Williamsburg, Incorporated, is vitally interested in
acquiring a portion of the said property for the purpose of extending the
historic area now restored; and
Whereas, the hereinbelow described portion of the said property now
owned by the said College includes the site of the eighteenth-century
public hospital and the Custis family property ; now, therefore
Be it enacted by the General Assembly of Virginia:
1. § 1. The Board of Visitors of the College of William and Mary in
Virginia is hereby authorized to sell and convey to Colonial Williamsburg,
Incorporated, upon such terms and conditions as it deems proper, subject
to the approval of the Governor, the following described property:
All that certain piece or parcel of land, with improvements thereon
and appurtenances thereto belonging, lying and being in the City of Wil-
liamsburg, Virginia, comprising 13.73 acres, and more particularly de
scribed as follows: ,
Beginning at an iron rod marking the intersection of the southern
line of Francis Street with the east occupational line of South Henry
Street, thence along the southern line of Francis Street N 85° 23’ E
1004.67’ to the property of the United States of America (Colonial
National Monument Parkway), thence S 4° 37’ E 485.96’ to a point,
thence S 85° 23’ W 113.03’ to a point, thence S 1° 48’ E 114.19’ to a point,
thence in a westwardly direction along a line parallel to and 600.00’ south
of the southern line of Francis Street S 85° 23’ W 936.17’ to a point in the
east occupational line of South Henry Street, thence along the east occu-
pational line of said street N 7° 03’ 40” E 97.82’, N 2° 43’ 10” E 109.03’,
N 0° 54’ 30” W 236.72’, N 4° 11’ 00” W 160.33’ to the point of beginning
and containing 13.73 acres of land.
2. Such conveyance shall be by deed in form approved by the Attorney
General of Virginia.
3. The net proceeds from the sale of said property shall be deposited in
the State Treasury to the credit of the College of William and Mary in
Virginia to be expended by the Rector and Visitors towards the construc-
tion of a new library in Williamsburg, or for debt reduction, subject to
approval of the Governor.
