An Act to amend and reenact § 35-8.1 of the Code of Virginia, relating to
requirements for gas burning heaters used in hotels, inns, houses of
entertainment, or other houses licensed for the lodging, care, or enter-
tainment of the public, the operation of which requires a State permit,
so as to prohibit within the sleeping quarters of any such premises
any gas burning device used for cooking, water heating, drying, or
refrigeration and to prescribe the conditions under which any such
device may be used in any room connected to the sleeping quarters
of any such premises.

Be it enacted by the General Assembly of Virginia:
1. That § 35-3.1 of the Code of Virginia be amended and reenacted as
follows:
§ 35-3.1. All gas burning heaters used in any hotel, inn, house of
entertainment, or other house, hereinafter referred to as premises, licensed
and kept for the lodging, care, or entertainment of the public in this State,
the operation of which requires a State permit, shall be so designed that
all products of combustion are collected within the heating unit, effectively
vented to the outside air to a height two feet above any obstruction within
a radius of fifteen feet, equipped with an approved down draft diverter
and wind cap, an automatic safety pilot and an automatic pilot device;
provided that the requirements of this section shall not be construed as
debarring gas burning heaters equipped with equally effective safety de-
vices, all of which have the approval of nationally recognized testing
agencies for use in such establishments.
No gas burning device used for cooking, water heating, drying, or
refrigeration shall be used in any room used for sleeping in any such
premises. If any such device is used in any room connected to any such
sleeping quarters, such room shall be of tight construction, properly
ventilated and equipped with a substantial door with a conventional latch
or lock between such room cnd such sleeping quarters.
