CHAPTER 165
An Act to create a commission to determine and establish a part of the
boundary line between Henry and Patrick counties; to prescribe its
powers and duties; to provide for the filing of a description of such
boundary when established, and the effect thereof; and to provide for
the payment of certain costs.

Be it enacted by the General Assembly of Virginia:
1. §1. There is hereby created a commission to ascertain, establish
and proclaim a certain disputed portion of the boundary line between the
counties of Henry and Patrick. The commission shall consist of three per-
sons appointed by the judge of the seventh judicial circuit of whom one
shall be a resident of one of the counties and two shall be residents of the
other county.
§ 2. The commissioners so appointed shall determine the true and
correct location of that part of the boundary between the counties of
Henry and Patrick between the point where such boundary crosses State
Highway Number 57 and the Philpott Dam. It shall, subject to the
approval of the judge of the seventh judicial circuit, have authority to
have any surveys or other investigations made as it shall deem necessary
in order to establish such boundary.
§ 3. Upon the completion of its study the commission shall file in the
clerk’s office of the circuit courts of the counties of Henry and Patrick,
in the office of the Secretary of the Commonwealth, and in the Virginia
State Library, a description of the boundary established by it; and the
boundary so described shall thereafter for all purposes be deemed to be
the boundary between such counties between the points indicated therein.
§ 4. Any costs incurred by the commission shall be a charge against
and paid by the governing bodies, in such proportion as shall be fixed by
the judge of the seventh judicial circuit by orders entered in the clerks’
offices of the circuit courts of the counties of Henry and Patrick.
2. An emergency exists and this act is in force from its passage.
