An Act to amend and reenact § 58-286 of the Code of Virginia, relating to
license taxation of an auctioneer, and to repeal §§ 54-798, 54-794,
58-285, 58-287, 58-288 and 58-288.1, relating, respectively, to account
of sales and statements required of certain auctioneers, authority of
an auctioneer to sell and do certain acts, classification of aucttoneers,
and license taxes required of livestock auctioneers, tobacco auctioneers
and auctioneers for livestock markets.

Be it enacted by the General Assembly of Virginia:
1. i That § 58-286 of the Code of Virginia be amended and reenacted as
ollows:
§ 58-286. Any person licensed as * an auctioneer may sell by auction
any property not prohibited by law. * An auctioneer shall pay for a license
the sum of * seventy-five dollars. * Such license shall be valid throughout
the State as a State license. Such license shall not be issuable quarterly, nor
shall the tax thereon be subject to proration, nor shall it authorize anyone
to sell by auction except the individual to whom it is issued; provided, how-
ever, that any such person who begins such business on or after July first
of any calendar year may be licensed for the residue of that calendar year
on the payment of a license tax of thirty-seven dollars and fifty cents. Any
licensed auctioneer who buys and sells on his own account is not relieved
of any license tax imposed by law on a person who buys and sells on his
own account. Nothing in this section shall be construed as exempting from
any tax imposed by law anyone for whom an auctioneer sells.
2. That §§ 54-798, 54-794, 58-285, 58-287, 58-288, and 58-288.1 of the
Code of Virginia are hereby repealed.
83. This act shall be in force on and after January first, nineteen hundred
sixty-one.
