AN ACT to amend and reenact § 51-111.70, as amended, of the Code of Vir-
ginia, relating to benefits for certain retired teachers and State em-
ployees.

Be it enacted by the General Assembly of Virginia:
1. That § 51-111.70, as amended, of the Code of Virginia, be amended and
reenacted as follows:
§ 51-111.70. On and after July one, nineteen hundred * fifty-eight
the amount of the retirement allowance otherwise payable to (1) any
former teachers who were retired under the provisions of Chapter 36 of
the Code of 1919 as it existed immediately prior to July one, nineteen
hundred forty-two or (2) any teachers and State employees retired since
June thirty, nineteen hundred forty-two under the provisions of the re-
pealed Virginia Retirement Act with thirty or more years of service in
case of service retirement or twenty or more years of service in case of
disability retirement, provided, in the case of service retirement such
teacher or State employee has attained sixty-five years of age, shall be
entitled to and shall receive a retirement allowance in an amount, which,
when added to the annual retirement allowance otherwise payable shall
not be less than * one thousand twenty dollars per annum; provided, how-
ever, that this provision shall not apply to increase any retirement allow-
ance of any retired teacher or State employee receiving a retirement
allowance which would have amounted to * one thousand twenty dollars
per annum if a reduced allowance had not been elected under one of the
options under the repealed Virginia Retirement Act, nor shall this pro-
vision apply to increase the annual retirement allowance of any beneficiary
who is receiving or who may receive a retirement allowance as a beneficiary
under one of the options elected under the repealed Virginia Retirement
Act. It is further provided that any person, who was a member of the
abolished system having not been refunded contributions credited to his
account and who would have been credited with thirty or more years of
service as a teacher or State employee in the abolished System, except for
the provisions of the abolished Act authorizing establishment of prior
service credit, may, upon attaining age sixty-five, qualify for and be paid
the allowance herein provided.
