CHAPTER 552
AN ACT to amend and reenact § 15-18, as amended, of the Code of Vir-
ginia, relating to local regulation of automobile graveyards; and to
amend the Code of Virginia by adding a section numbered 38-279.8,
prohibiting establishment of automobile graveyards except under
certain conditions; requiring the erection of fences or hedges around
certain automobile graveyards; providing for enforcement, and pre-
scribing penalties.

Be it enacted by the General Assembly of Virginia:
1. That § 15-18, as amended, of the Code of Virginia, be amended and
reenacted, and that the Code of Virginia be amended by adding a section
numbered 33-279.3, as follows:
§ 15-18. The board of supervisors of each county and the council
of each city and town in this State may adopt ordinances imposing
* license taxes upon and otherwise regulating the maintenance and opera-
tion of places commonly known as automobile graveyards, and may
prescribe fines and other punishment for violations of such ordinances.
No such ordinance shall be adopted until after notice of intention to
propose the same for adoption shall have been published prior to its
adoption once a week for two successive weeks in some newspaper pub-
lished in such county or city or, if there be no newspaper published therein,
then in some newspaper having general circulation in such county or
city and no such ordinance shall become effective until it shall have been
published in full for two successive weeks in a like newspaper.
* As used in this section the term “automobile graveyard” shall have
the meaning ascribed to it in § 88-279.8.
§ $8-279.8. (a) For the purpose of this section, “automobile grave-
yard” means any lot or place which is exposed to the weather and upon
which more than five motor vehicles of any kind, incapable of being
operated, and which it would not be economically practical to make
operative, are placed, located or found. ae
(b) No automobile graveyard shall hereafter be established within
five hundred feet of any State highway in this State. ; .
(ce) No automobile graveyard shall hereafter be established within
one thousand feet of any primary State highway, except on land which
has been specifically designated or zoned for such use by the governing
body of the county or city in which it is proposed to be established.
(d) Any person who maintains an automobile graveyard, any part of
which is within five hundred feet of any State highway, shall erect and
maintain a fence or hedge around such automoible graveyard. Such fence
or hedge shall be at least six feet high and sufficient to conceal such
automobile graveyard from the view of a person standing at the same
level as such graveyard; provided, however, that no fence or hedge shall
be required in any case when erection thereof would not effectively con-
ceal a substantial portion of such automobile graveyard from the view of
@ person on such highway.
