An Act to amend the Code of Virginia by adding a section numbered
28-98.2, to prohibit taking oysters with patent tongs in certain areas
and to prescribe penalties for violations. [Ht 586]

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding a section numbered
28-93.2 as follows:
§ 28-93.2. It shall be unlawful for any person to use or employ patent
tongs for the purpose of taking oysters in the area hereinafter described :
Beginning at a point of land on the south side of the mouth of Brown’s
Bay, Gloucester County; thence in a northeasterly direction across Mob-
jack Bay to a point of land on the northwest side of the mouth of Pepper
Creek, in Mathews County; thence in a general northwesterly direction
along the northeast side of Mobjack Bay to the mouth of East River, 1n-
cluding East River and its tributaries; thence across the mouth of said
river along the Southwest side of White’s Neck, Mathews County, to the
mouth of North River, including all of North River and its tributaries;
thence across the mouth of North River to Ware Neck Point, near the
mouth of Ware River, including Ware River and its tributaries; thence
across the mouth of said Ware River to the mouth of Severn River, in-
cluding Severn River and its tributaries; thence across the mouth of
Severn River to a point on the north side of Brown’s Bay, including
Brown’s Bay and its tributaries; thence in a southerly direction across
the mouth of Brown’s Bay to the point of beginning.
Any person violating the provisions of this section shall be guilty of
a misdemeanor and upon conviction be punished by a fine of not less than
twenty-five dollars nor more than five hundred dollars, or by confinement
in jail not less than ten days nor more than thirty days, or both.
