CHAPTER 441
An Act to amend the Code of Virginia by adding a section numbered,
15-792.1, to impose certain conditions precedent to acceptance of cer-
tain land for public use.

Be it enacted by the General Assembly of Virginia: ;
1. That the Code of Virginia be amended by adding a section numbered
15-792.1 as follows:
§ 15-792.1. The governing body of any county, city or town may
prohibit the acceptance for dedication for public use any right of way
located within the boundaries of any subdivided property which shall have
constructed thereon any road, street, paving, curb, gutter or sidewalk, the
construction of which was financed in whole or in part with private funds
until the owner or developer shall have (1) certified to such governing
body that the construction costs of such road, street, paving, curb, gutter
and sidewalk have been paid to the person, firm or corporation constructing
such facilities, or (2) shall have furnished to said governing body a certi-
fied check or bond, approved by the legal representative or other authorized
officer of the governing body, sufficient to cover the cost of such improve-
ments, and to guarantee their installation and completion, or (3) shall
exhibit to said governing body an agreement or agreements between the
owner or developer and a qualified contractor or contractors for the instal-
lation and completion of said improvements and the contractor or con-
tractors performance bond, satisfactory to the legal representative or other
authorized officer of the governing body, in an amount sufficient to cover
the cost of the improvements and to guarantee their installation and
completion.
