An Act to amend and reenact §§ 10-1, 10-8, as amended, 10-5, 10-6, 10-8.1,
10-12, 10-18, 10-14, 10-118, 10-119, 10-120, 10-128 and 10-130 of the
Code of Virginia, relating generally to the Department of Conserva-
tion and Development and Divisions thereof, and to the Advisory
Council on the Virginia Economy, so as to change the title of the
Board, Director and Department of Conservation and Development,
to terminate the terms of the members of the Board, and to reduce
the number of members of the Board, to provide for certain divisions
within the Department, to impose certain duties and functions upon
the Board, to impose duties upon the Director of the Department, and
to provide for the duties of the Division of Industrial Development;
and to repeal § 10-121 of the Code of Virginia, relating to the Advisory
Committee on Planning and Economic Development. CH 482]

Be it enacted by the General Assembly of Virginia:
1. That §§ 10-1, 10-3, as amended, 10-5, 10-6, 10-8.1, 10-12, 10-18, 10-14,
10-118, 10-119, 10-120, 10-128 and 10-130 of the Code of Virginia, be
amended and reenacted as follows:
§ 10-1. There shall be a Department of Conservation and Economic
Development, hereafter in this title sometimes called the Department, and
a Director of Conservation and Economic Development, hereafter some-
times called the Director, who shall be the head and chief executive officer
of the Department and who shall exercise such powers and perform such
duties as may be conferred or imposed upon him by law, or in accordance
with law. The Director shall be appointed by the Governor subject to con-
firmation by the General Assembly, if in session when the appointment is
made, at that session, and if not then in session, at the next succeeding
session. He shall hold office at the pleasure of the Governor for a term
coincident with the term of the Governor making the appointment, or until
his successor shall be appointed and qualified. Any vacancy in the office of
Director shall be filled in the same manner in which original appointments
are made. All references in this Code or any other law to the Department
or Board of Conservation and Development and the Director of Conserva-
tion and Development shall be deemed to refer to the Department or Board
of Conservation and Economic Development and the Director of Conserva-
tion and Economic Development.
§ 10-8. There shall be a Board of Conservation and Economic Devel-
opment, hereafter in this title sometimes called the Board. * The terms of
the members of the Board in office when this amendment takes effect are
terminated. Thereafter the Board shall consist of * nine members to be
appointed by the Governor * subject to confirmation by the General Assem-
bly, if in session when such appointments are made, at that session, or tf
not in session, at the next succeeding session. Persons so appointed shall
hold office at the pleasure of the Governor for terms as follows: Of the
initial appointments, * two shall be for terms of one year, * two shall be
for terms of two years, * two shall be for terms of three years, and * three
shall be for terms of four years each, and thereafter all appointments shall
be for terms of four years each. * No person shall be eligible to succeed
himself as a member of the Board for more than one term. Any vacancy
shall be filled by the Governor for the unexpired term. In making appoint-
ments, the Governor shall endeavor to select appointees of such qualifica-
tions and experience that the membership of the Board shall include persons
suitably qualified to consider and act upon the various special interests and
problems of importance, which, under the laws of the Commonwealth, the
Board may be required to consider and act upon. The Board may appoint
subcommittees of not less than three, its members to consider and deal
with such special interests and problems, and may delegate to such sub-
committees any powers and duties which may be conferred by law upon
the Board in relation to such special interests and problems.
§ 10-5. The Board shall meet at least once in every * sixty days, and
on the call of the chairman * , when in * his opinion * additional meetings
are expedient or necessary. * Five members shall constitute a quorum of
the Board for all purposes.
§ 10-6. The Director shall devote his full time to the performance
of his official duties and shall receive such salary as may be provided by
law for the purpose. The members of the Board shall receive no salaries,
but shall be paid their necessary traveling and other expenses incurred in
attendance upon meetings, or while otherwise engaged in the discharge of
their duties, and the sum of * fifteen dollars a day for each day or portion
thereof in which they are engaged in the performance of their duties.
§ 10-8.1. The * Board shall establish in the Department of Conserva-
tion and Economic Development the following divisions through which the
several functions of the Department and the corresponding powers and
duties shall be exercised and discharged: Division of Forestry, Division of
* Mineral Resources, Division of Parks, Division of Water Resources, Divi-
sion of * Industrial Development, * Division of Public Relations and Adver-
tising, and such other Divisions as may be necessary. The Director shall
appoint competent persons to direct the work of such divisions, and may
delegate to the head of any such division any of the powers and duties
relating to the work of the division that may be conferred or imposed hy
law upon the Director, and in his discretion may require of such division
heads proper bonds.
§ 10-12. The Board of Conservation and Economic Development shall
* formulate and establish the general policies and objectives of the Depart-
ment of Conservation and Economic Development which policies and objec-
tives shall be executed by the Director. The Board shall specifically formu-
late, promulgate, institute and advance programs for the purpose of encour-
aging the location of new industries throughout the State and the expansion
of existing industries. The Board shall direct the preparation of the budget
of the Department and of the respective divisions thereof for the considera-
tion of the Governor in the discharge of his duties in the preparation of
the State budget for submission to the General Assembly. The Board may
* institute investigations, and * make recommendations to * the Governor
upon his request or upon its own motion.
§ 10-18. Subject to direction of the Board the Director shall have
control of the expenditure of any State advertising funds and shall have
control of and expend such funds for advertising the resources and advan-
ges of the Commonwealth in such manner as he may deem best. The
Director shall cooperate so far as it may be practicable and expedient with
other organizations in the State engaged in similar or related work, and
shall have full power and authority to acquire by gift or transfer property
or funds to be so expended.
_ § 10-14. The Governor may, at any time, direct that any appropria-
tion or other fund available to any department, officer, board, commission,
or other agency of the State for publicity or advertising purposes be trans-
ferred to the Department of Conservation and Economic Development, or
direct that it be expended under the supervision of the * Board, in either
of which events the * Board shall direct the expenditure of such appropria-
tion or other funds in such manner as he may deem best for the general
good of the Commonwealth and the special good of the agency concerned.
§ 10-118. In the Department of Conservation and Economic Devel-
opment there shall be a Division of * Industrial Development, * which Divi-
sion, under the Director and the Board, is charged with the responsibilities
for carrying out all phases of the State’s program in the field of industrial
development including specifically the duty to (a) cooperate with the Divi-
sion of Public Relations and Advertising tn the preparation of an effective
industrial advertising program and respond to inquiries resulting from the
advertising program for new industries and received from other sources;
(b) make available, in conjunction and cooperation with localities, cham-
bers of commerce, and other private or public groups, to prospective new
industries basic information regarding industrial sites, natural resources
and labor supply, and other pertinent factors of interest and concern to
such industries; and (c) formulate, promulgate and advance programs
throughout the State for the purpose of encouraging the location of new
industries in the State and the expansion of existing industries.
§ 10-119. There shall be a * Commissioner who shall be the head
and chief executive officer of the Division of * Industrial Development. He
shall be appointed by the Director and shall receive such compensation as
may be provided by law for the purpose.
§ 10-120. The Commissioner shall exercise such of the powers and
perform such of the duties relating to State planning and * industrial
development, including powers and duties involving discretion, which are
conferred by the provisions of this title on the Director, as may be dele-
gated to him by the Director, and such other powers and duties as may be
lawfully delegated to the Commissioner, and such powers and duties as
may be conferred upon the Commissioner by 1aw.
§ 10-128. The members of the Council may make rules for their own
organization. The Division of * Industrial Development in the Department
of Conservation and Economic Development shall serve as Secretariat to
the Council.
§ 10-130. The Division of * Industrial Development shall serve the
Council as its Secretariat or central administrative office and subject to
the approval of the Director of Conservation and Economic Development
shall furnish the Council with the necessary stationery and supplies and
shall have done for the Council such printing as may be necessary.
2. § 10-121 of the Code of Virginia is repealed.
