An Act to amend and reenact § 15-861 of the Code of Virginia, relating to
the vote of members of boards of supervisors necessary in cases of
protested zoning changes in certain counties. CH 222]

Be it enacted by the General Assembly of Virginia:
om That § 15-861 of the Code of Virginia be amended and reenacted as
ollows:
§ 15-861. In case of a protest against a proposed amendment, supple-
ment, change, modification or repeal of any regulation, restriction or boun-
dary, duly signed by the owners of twenty per centum or more either of the
area of land included in such proposed amendment, supplement, change,
modification or repeal or of the land within five hundred feet of the boun-
dary of the area of land included in such proposed amendment, supplement,
change, modification or repeal, such proposed amendment, supplement,
change, modification or repeal shall not become effective except by the
favorable vote of four-fifths of all members of the board of supervisors of
such county; provided, that in any county in which the board of super-
visors consists of four members and adjoining a city lying wholly within
this State having a population of more than two hundred thirty thousand
such proposed amendment, supplement, change, modification or repeal shall
require a favorable vote of three-fourths of all members of the board of
supervisors of such county.
In calculating the area of land included as land within five hundred
feet of the boundary of the land included in any such proposed amend-
ment, supplement, change, modification or repeal, there shall be excluded
therefrom publicly owned land but such exclusion shall not operate to
extend the distance within which a property owner has the right to enter
@ signed protest. The signatures required by this section need not all be
affixed to the same copy of the protest but each signature shall be witnessed
by a person whose affidavit to that effect shall be attached to the copy of
the protest to which such signature is affixed.
