An Act to amend and reenact §§ 24-28.1, 24-28.4 and 24-845.7 of the
Code of Virginia, relating, respectively, to persons offering to vote
in elections in the Commonwealth of Virginia who are in the active
service of the armed forces of the United States and who have
been discharged from active service as members of the armed forces
of the United States, to the preparation and printing of ballots and
to the protection of certain records. CH 112)

Be it enacted by the General Assembly of Virginia:
1. That §§ 24-28.1, 24-23.4 and 24-845.7 of the Code of Virginia be
amended and reenacted as follows:
§ 24-23.1. Whenever a majority of the judges of election of any
precinct are satisfied, by such evidence as they may deem proper, that a
person offering to vote in person in any election, is in active service as a
member of the armed forces of the United States in time of war, and that
such person is otherwise qualified to vote, they shall permit such person to
vote in such election (and also in any second primary election that may be
held in connection therewith) without being required to register or to
pay any poll tax; provided, however, that such person shall execute and file
with the judges of election an affidavit, subscribed and sworn to before a
judge of election, substantially as follows:
“I do swear (or affirm) that I am now and have been a citizen and
domiciliary resident of Virginia since the........... AY OLirsccssssassssnstsssrescenies 5» 19.
and am a resident of the neces (city or county) of...
(name of city or county) residing at... ..(street and number or
place of residence therein) and am now in active service in the armed
forces of the United States; that I am twenty-one years of age; and that
by exercising the privilege of voting I acknowledge and accept all of the
responsibilities and obligations of full citizenship of the Commonwealth
of Virginia. The name or number of my voting precinct 18a. cccceceennecnenne
(if known, so state).
Judge of Election”.
The affidavit shall be returned to the clerk’s office with the ballots
and shall be preserved by the clerk as a public record until such time as
the judge of the circuit or corporation court of the county or city in
whose clerk’s office the affidavit is filed shall order the same to be de-
stroyed.
§ 24-23.4. Before allowing any person to vote pursuant to either
§ 24-23.2 or § 24-23.3, such person shall be required to execute and file
with the judges of election an affidavit subscribed and sworn to before
a judge of election substantially as follows:

domiciliary resident of Virginia since the..................... Day Of eee a

ing I acknowledge and accept all of the responsibilities and obligations of
full citizenship of the Commonwealth of Virginia. The name or number of

The affidavit shall be returned to the clerk’s office with the ballots
and shall be preserved by the clerk as a public record until such time as
the judge of the circuit or corporation court of the county or city in which
clerk’s office the affidavit is filed shall order the same to be destroyed.
§ 24-345.7. For the transmission of said ballots to said voter and his
return thereof to the Board such Board shall cause to be prepared of paper
of the lightest available weight possessing the necessary tensile strength
(a) a covering envelope, (b) an outside return envelope of appropriate
smaller size, gummed and ready for sealing, and (c) an inside envelope in
which to place and seal the marked ballot.
In the left-hand corner of the covering envelope shall be printed the
words “Official Virginia War Ballot”, or such other words as the Acts
of Congress or regulations of the transmitting Federal agency may require.
On the outside return envelope shall be printed as the addressee
thereof the words “State Board of Elections of Virginia, Richmond,
Virginia”, and in the top left-hand corner the words “Official Virginia
War Ballot”, or such other words as may be required by Acts of Congress
or the said transmitting Federal agency.
On the inside envelope in which the voter is to enclose his ballot shall
be printed upon one side the following:
“Official Virginia War Ballot.”
“Voter must place ballot herein and seal.”
-and upon the other side the following words:
“Oath of Voter’

If the absentee ballot is for a primary election, there shall be added
to the above-prescribed oath the words “and that I am a member of the
