An Act to amend the Code of Virginia by adding in Chapter 1 of Title
88.1 a new article numbered 9, containing sections numbered $8.1-70.1
through 88.1-70.4, to provide for the appointment of agents for, and
service of process on, unlicensed nonresident insurance brokers and
agents.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding in Chapter 1 of Title
88.1 an article numbered 9, containing sections numbered 88.1-70.1 through
38.1-70.4 as follows:
Article 9
Unauthorized Nonresident Brokers
And Agents Process Act
§ 38.1-70.1. The provisions of this article may be known and cited
as the Unauthorized Nonresident Brokers and Agents Process Act.
§ 38.1-70.2. Any of the following acts in this State, effected by mail
or otherwise, by an unlicensed nonresident broker or agent, namely: (1)
the issuance or delivery of contracts of insurance to residents of this
State or to corporations authorized to do business therein, (2) the solicita-
tion of applications for such contracts, (3) the collection of premiums,
rship fees, assessments or other considerations for such contracts,
or (4) the transactions of any other insurance business in connection with
such contracts, is equivalent to and shall constitute an appointment by
such broker or agent of the clerk of the Commission as his or its agent
for the service of process.
§ 38.1-70.8. Service of process or notice upon any such broker or
agent in any suit, action or proceeding arising out of or in connection
with such business in this State shall be made in the manner prescribed
in § 13.1-119.
§ 38.1-70.4. Nothing in this article shall limit or abridge the right
to serve any process or notice upon any such broker or agent in any other
manner permitted by law.
