An Act to amend and reenact § 59-218, as amended, of the Code of Vir-
ginia, relating to certain fireworks exploded on "private property; to
amend the Code of Virginia by adding a section numbered 59-214.1,
o provide for destruction of certain fireworks in certain cases; and
to repeal §§ 59-220 and 59-221, relating to fireworks in this State.

Be it enacted by the General Assembly of Virginia:
1. That § 59-218, as amended, of the Code of Virginia, be amended and
reenacted and that the Code of Virginia be amended by adding a section
numbered 59-214.1, as follows:
§ 59-214.1, Any law enforcement officer arresting any person for a
violation of this chapter shall seize any article mentioned in § 59-214 in
the possession or under the control of the person so arrested and shall hold
the same until final disposition of any criminal proceedings against such
person. If a judgment of conviction be entered against such person, the
court shall order destruction of such articles upon expiration of the time
allowed for appeal of such judgment of conviction.
§ 59-218. This chapter shall not apply to * sparklers, fountains,
Pharoah’s serpents, caps for pistols, nor shall it apply to pinwheels com-
monly known as whirligigs or spinning jennies, when used, ignited or
exploded on private property with the consent of the owner of such
property.
2. That §§ 59-220 and 59-221 of the Code of Virginia are repealed.
