CHAPTER 99
An Act to amend and reenact § 14 of Chapter 376 of the Acts of Assembly
of 1988, approved March 81, 1938, which provided a new charter for
the town of Herndon in Fairfax County, and to amend the said chapter
by adding thereto a section numbered 20-a, the amended and new sec-
tions, respectively, relating to the salaries of certain town officials
and to special justices.

Be it enacted by the General Assembly of Virginia:
1. That § 14 of Chapter 376 of the Acts of Assembly of 1938, approved
March 31, 1938, be amended and reenacted and that the said chapter be
amended by adding thereto a section numbered 20-a as follows:
§ 14. The council shall fix the salaries of the mayor, councilmen,
treasurer, clerk, sergeant, deputy sergeant and other employees, as it may
deem appropriate at its first meeting in September, which salary shall be
for a period of one year; * provided, that a salary may be paid one or more
councilmen or a salary in excess of that paid other councilmen may be paid
one or more councilmen, if a majority of the council determine that addi-
tional duties and responsibilities assumed by such councilman or councilmen,
by reason of committee assignment or otherwise, warrant such salary, and a
majority of said council authorize such additional compensation.
§ 20-a. The council may also appoint a special justice for the issuance
of warrants of arrest; such justice shall also have power, if the council
so prescribes, to grant or deny bail in proper cases and when bail is denied
to remand persons to jail as provided by law. The term of office of such
special justice shall not be for a term beyond that of the council by which
he is appointed. His compensation shall be that provided by general law.
2. Anemergency exists and this act is in force from its passage.
