‘CHAPTER 76
An Act to provide for the construction and maintenance of a toll bridge
with connecting approaches by Cedar Island Bridge Corporation, a
Virginia corporation, over certain property of the Commonwealth of
Virginia in Accomack County; to provide for the acquisition thereof
by the Commonwealth; and to repeal certain acts and parts thereof.

Whereas the Cedar Island Bridge Corporation, a public utility corpo-
ration by virtue of the laws of the State of Virginia, is desirous of build-
ing and constructing a toll bridge or bridges with necessary approaches
thereto connecting Cedar Island, now known as Ocean City, Virginia, and
Custis Neck, both in Lee Magisterial District, Accomack County, Virginia;
and
Whereas, said bridge or bridges and approaches will cross “Cross
Creek”, “‘Long Boat Creek”, and lowlands, marshes, meadows, and certain
small creeks lying between the said Cedar Island and Custis Neck, both in
said county of Accomack; and .
Whereas titles to said creeks, lowlands, marshes, meadows and certain
small creeks are the property of the Commonwealth of Virginia as de-
scribed by § 62-1 of the Code of Virginia,
Be it enacted by the General Assembly of Virginia:
1. § 1. The Cedar Island Bridge Corporation be, and the same hereby
is, authorized and empowered to build, erect and construct, preserve and
maintain a toll bridge or bridges with connecting approaches across “Cross
Creek”, “Long Boat Creek” and lowlands, marshes, meadows and certain
small creeks intersecting the same, lying and being between Cedar Island,
now known as Ocean City, Virginia, and Custis Neck, both in Lee Magis-
terial District, Accomack County, Virginia, and the said Cedar Island
Bridge Corporation is hereby given and granted any and all rights neces-
sary and needful for the building, erection and construction of said toll
bridge or bridges and approaches and for the maintenance, preservation
and repair thereof.
§ 2. Cedar Island Bridge Corporation shall have a right-of-way of
five hundred feet for this purpose and the construction of the bridge or
bridges and approaches thereto shall conform to good engineering practices
and such reasonable standards in conformance therewith as may be pre-
scribed by the State Highway Commission.
§ 3. Should the construction of such bridge or bridges and their neces-
sary approaches not be commenced within a period of three years from the
date that this Act becomes effective, and should such bridge or bridges
and their necessary approaches not be completed within a period of five
years from the date of this Act, then the Cedar Island Bridge Corporation
shall automatically forfeit its rights to said right-of-way and same shall
automatically revert to the Commonwealth of Virginia.
§ 4. The Commonwealth, acting through the State Highway Commis-
sion, may purchase such bridge or bridges and the approaches thereto
pursuant to § 33-224 of the Code of Virginia.
2. All other general or special laws or parts thereof in conflict herewith
are repealed to the extent of such conflict.
