An Act to amend the Code of Virginia by adding to Chapter 12 of Title
56 thereof a new article numbered Article 2.1, containing sections
numbered 56-287.1 through 56-287.8, authorizing common carriers
by railroad and express to operate motor vehicle carriers under cer-
tain conditions.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding in Chapter 12 of
Title 56 thereof a new article numbered 2.1, containing sections numbered
56-287.1 through 56-287.3 as follows:
ARTICLE 2.1.’
Motor Vehicle Carriers Operated by Common Carriers
By Railroad and Express
§ 56-287.1. ‘Certificates and warrants to operate motor vehicle car-
riers to be issued common carriers by railroad and express.—The Com-
mission, shall, upon a showing of public convenience and necessity, not-
withstanding the provisions of § 56-281 of the Code of Virginia, issue to
any common carrier by railroad or any common carrier by express, upon
its application therefor, a certificate as a restricted common carrier to oper-
ate motor vehicles upon the highways of the State for the transportation
of property, which transportation shall be auxiliary to or supplemental
of rail or express service, such certificate to show the stations between
which the operation is to be conducted, and a warrant or warrants iden-
tifying the trucks or vehicles to be used in such operation which shall be
limited to less than carload freight or express in the case of a railroad as
a substitute for transportation by rail from freight station or express
station to freight station or express station on its line of railroad on rail-
road bills of lading or express receipts, and in the case of an express
company, as a substitute for transportation by rail from express station
to express station on any line of railroad on express receipts, at the pub-
lished railroad or express tariff charges, whichever may be applicable.
§ 56-287.2. Assignment, sale, lease, etc. of certificate and warrants.
—No common carrier by railroad or common carrier by express shall
make any assignment, sale, lease or other agreement of any kind whatso-
ever for the operation of motor vehicles under authority of the certificate
or warrant issued pursuant to § 56-287.1 by or on behalf of such common
carrier by railroad or common carrier by express, unless the Commission
shall have first approved such assignment, lease, sale or other agreement
with respect thereto, and then only upon such terms and conditions as
ed be set forth in the order of the Commission approving such trans-
action.
§ 56-287.3. Surrender of certificate and warrants.—Any common
carrier by railroad or any common carrier by express which shall, except
for reasons beyond its control, discontinue operation of motor vehicles
pursuant to the certificate granted under the provisions of this article for
a period of thirty consecutive days shall, upon the expiration of such
thirty-day period, return to the Commission for cancellation the certifi-
cate and warrants covering such operation.
