An Act to authorize the Commonwealth of Virginia to transfer and con-
vey to the City of Richmond easements in certain property in the Cit
of Richmond; and to impose certain restrictions in connection wit.

Whereas, Chapter 244 of the Acts of the General Assembly of 1950
provided for the erection of a memorial in recognition of the patriotic
services of Virginians in World War II; and
Whereas, the erection of the memorial was conditioned upon the City
of Richmond deeding to the Commonwealth of Virginia, without cost to
the Commonwealth, of a site for the memorial deemed suitable by the
Governor, the Virginia World War II Memorial Commission and the City
of Richmond; and
Whereas, the City of Richmond acquired a site so approved and con-
veyed it to the Commonwealth of Virginia; and
Whereas, the site conveyed included land in which the City of Rich-
mond had installed and was maintaining and operating underground con-
duit for transmitting electric energy ; and
Whereas, the continued maintenance and operation of the conduit
and the transmission of electric energy therein will not in any manner
interfere with the construction, maintenance and operation of the war
memorial; Now, Therefore,
Be it enacted by the General Assembly of Virginia:
_ § 1. The Commonwealth of Virginia, acting by and through the
Virginia World War II Memorial Commission, is authorized, empowered
and directed to convey by deed, executed by its Chairman, to the City of
Richmond easements in those certain pieces or parcels of land now belong-
ing to the Commonwealth of Virginia, for the transmission of electric
energy in underground conduit which may be from time to time con-
structed, reconstructed, repaired, replaced, maintained and operated for
the purpose therein, lying and being in the City of Richmond bounded and
described as follows:
Easement No. 1:
Beginning at a point on the northwestern edge of the curb on the
northwestern side of Second Street, 144.45 feet southwest of the south-
western face of the southwestern guard rail post of the Second Street
Viaduct; thence extending North 49° 59’ 00” West 6.35 feet to a point;
thence extending South 40° 00’ 30” West, at 13.99 feet passing 5 feet
northwest of the center of a manhole for an underground electric power
conduit of the City of Richmond; thence continuing parallel to and 5 feet
northwest of the center line of said underground conduit, in all, 396.68
feet to a point 5 feet northwest of the center of a second manhole for
said underground conduit; thence continuing parallel to and 5 feet north-
west of the center line of said underground conduit, South 46° 58’ 30”
West, at 804.58 feet to a point on the northwest edge of the curb on the
fortes side of Second Street; thence extending northeasterly along
Lew northwestern edge of said curb line 704.00 feet to the point of
ginning.
Easement No. 2:
Beginning at a point on the eastern edge of the sidewalk on the
eastern side of Belvidere Street, said point being 9.10 feet northeast of
the intersection of the curved guard rail at the northeastern end of the
Robert E. Lee Bridge with the aforesaid sidewalk and 5 feet southwest
of the center line of an underground electric power conduit of the City of
Richmond; thence following parallel to and 5 feet southwest of the center
line of said underground conduit South 35° 43’ 30” East, at 42.02 feet to
a point on the northwestern edge of curb on the northwestern side of
Second Street, said point being 40.70 feet northeast of the edge of a pier
for the Robert E. Lee Bridge at its intersection with a retaining wall on
the northern side of the Second Street approach to said bridge; thence
northeasterly along the northwestern edge of the aforesaid curb 10.82
feet to a point 5 feet northeast of said underground conduit; thence fol-
lowing parallel to and 5 feet northeast of said underground conduit North

35° 43’ 80” West, at 49.50 feet to a point on the eastern edge of the side-
walk on the eastern side of Belvidere Street; thence extending southerly
along the eastern edge of said sidewalk 11.15 feet to the point of beginning.
The location of such easements are also shown and described on a plat
of a survey on file in the office of the Department of Public Works of the
City of Richmond entitled: “Plan for the Underground Utility Easement
at World War II Memorial Site in the Vicinity of Belvidere St. and 2nd
St. Approach”, marked “Drawing No. 0-12317”, a copy of which is to be
attached to and made a part of the deed. The deed shall be approved by
the Attorney General of Virginia as to form. ;
§ 2. It is expressly provided that the easements authorized by this
act shall be exercised only in such manner as not in any way to interfere
with the construction, maintenance and operation of the War Memorial
and further provided that the exercise of the easements will not involve
any + or expense or damage to the War Memorial or to the Common-
we ;
