duties of the commission; to authorize and direct the Director of the
Department of Conservation and Development to acquire and main-
tain such memorial and site; and to appropriate funds, (H 421]

Be it enacted by the General Assembly of Virginia: . .
1. § 1. There is hereby created a commission to provide specifications
for, and to approve, a marker or other memorial to Chief Justice John
Marshall and to select an appropriate site therefor at his birthplace at
Midland, Fauquier County, Virginia. The commission shall consist of five
persons who shall be appointed by the Governor. The Commission shall
elect one of its members as chairman. Members of the Commission shall
receive no compensation for their service thereon but shall be paid their
necessary traveling and other expenses incurred in the performanc2 of
their duties.
§ 2. The Director of the Department of Conservation and Develop-
ment is authorized and directed to acquire the marker or memorial ap-
proved by, and the site therefor selected by, the Commission, and for such
purposes is authorized to acquire the same by purchase or gift. The Direc-
tor is further authorized to exercise the right of eminent domain on behalf
of the Commonwealth of Virginia in acquiring land or property therein
required for such site.
§ 3. There is hereby appropriated to the Department of Conserva-
tion and Development, in addition to any other sums heretofore or here-
after appropriated, the sum of five thousand dollars, which sum, or so
much thereof as may be necessary, shall be expended by the Department
in carrying out the purposes of this act and in paying the expenses of the
Commission.
