[H 366]
Approved March 31, 1956
Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding a new section
numbered 8-138.2 as follows:
§ 8-138.2. When any case, or other matter is pending in any court
at the time the court is abolished or the jurisdiction thereof to hear said
case, or other matter is otherwise removed or deprived by statute, and
the statute abolishing or depriving the courts fails to transfer all pending
matters, then said case, or other matter is hereby deemed to be trans-
ferred by operation of law to the court, whether newly created or other-
wise, having jurisdiction thereof and meeting requirements of venue;
all cases, or other matters so transferred shall then proceed as though
they had originated therein. The clerk of the court receiving any of the
above shall, if requested so to do by any party in interest, enter an order
reciting the name of the court from which the matter was transferred,
date of transfer or such other pertinent information deemed necessary,
and shall place it on the proper docket of the court.
