An Act to amend and reenact § 33-111, as amended, of the Code of Vir-
ginia, relating to lending or renting equipment and selling materials
and supplies by the State Highway Commission to cities, towns and
school boards for building or repairing roads and streets. S 860

Be it enacted by the General Assembly of Virginia:
1. That § 33-111, as amended, of the Code of Virginia be amended and
reenacted as follows:
§ 33-111. The Commission may lend or rent equipment and sell
materials and supplies used in the building or repairing of roads and
streets to any city, town, county, or school board, upon such terms and con-
ditions as may be agreed upon by the Commission and such city, town,
county, or school board. Provided the governing body of such city, town,
county, or school board submits to the Commission a certificate setting
forth that the material or equipment cannot be furnished from private
sources within a reasonable time. Provided further that the foregoing
proviso shall not apply to towns with a population of less than thirty-five
hundred inhabitants or to the purchase of paint for traffic marking pur-
poses by any city, town, county, or school board.
