CHAPTER 408
An Act to amend the Code of Virginia by adding thereto sections num-
bered 26-16.1 and 26-85.1, relating to certain information to be re-
turned to fiduciaries under certain circumstances. [H 418]

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding thereto sections
numbered 26-16.1 and 26-35.1 as follows:
§ 26-16.1. All inventories filed with the Clerk and recorded by him,
as required by §§ 26-14 and 26-16 of the Code of Virginia, may, after the
same shall have been actually recorded, compared and indexed as required
by law, be destroyed, or returned to the fiduciary. .
All original accounts of sales filed with the Clerk and recorded by him
as required by §§ 26-15 and 26-16 of the Code of Virginia, shall, after the
same shall have been confirmed, recorded and compared and indexed,
as required by law, be returned by the Clerk to the fiduciary who made
such account upon the request of such fiduciary. All such original accounts
of sale which shall have remained in the Clerk’s Office three (3) years after
the confirmation thereof, without being called for by the fiduciary, may
be destroyed by the Clerk. Provided, nothing in this section shall apply
to cases in which the original documents are recorded by binding. _
§ 26-35.1. After the reports filed with the Clerk in accordance with
§ 26-35 of the Code of Virginia shall have been confirmed, and shall
have been actually copied in the records of fiduciary reports, compared
and indexed as required by law, the Clerk shall, on the request of the
fiduciary who filed the same, return the original thereof to such fiduciary.
All such original reports which remain in the Clerk’s Office three
(3) years after the same shall have been confirmed may be destroyed
by the Clerk. Provided, nothing in this section shall apply to cases in
which the original documents are recorded by binding.
