An Act to amend and reenact § 6 of Chapter 180 of the Acts of Assembly
of 1942, approved March 9, 1942, relating to composition, term of
office, organization and salaries of the Elizabeth River Tunnel Com-
mission.

Be it enacted by the General Assembly of Virginia:
1. That § 6 of Chapter 130 of the Acts of Assembly of 1942, approved
March 9, 1942, be amended and re-enacted as follows:
§ 6. A commission, to be known as the “Elizabeth River Tunnel Com-
mission,” is hereby created as the governing body of the Elizabeth River
Tunnel District created by this act. The commission shall consist of five
(5) members, each of whom shall be appointed by the Governor of the
State of Virginia. One member of the commission shall be a resident
of the city of Portsmouth, one member of the commission shall be a resi-
dent of the county of Norfolk, two members of the commission shall be
residents of the city of Norfolk and the remaining member of the com-
mission shall be * the State Highway Commissioner. The members of the
commission shall be originally appointed for terms of one (1), two (2),
three (3), four (4), and five (5) years, respectively. Each member of the
commission shall hold office from the date of his appointment until his
successor shall be duly appointed and qualified. The Governor shall desig-
nate one of the said appointees to act as chairman. Upon the expiration
of the term of each member originally appointed to the commission, his suc-
cessor shall be duly appointed by the Governor of the State of Virginia
for a term of five (5) years. Any person appointed, to fill a vacancy shall
serve only for the unexpired term and any member of the commission
shall be eligible for reappointment; provided, however, no person other
than the State Highway Commissioner shall be eligible to serve for or
during more than two successive terms except a member heretofore or
hereafter appointed to fill a vacancy may be eligible for two additional
successive terms after the term he was appointed to fill has expired; and
incumbency during the current term when this amendment takes effect
constitutes the first of the two successive terms in respect to eligibility for
appointment. Within thirty (30) days after the appointment of the orig-
inal members of the commission the commission shall meet on the call of
its chairman and elect one of its members as vice-chairman, and the com-
mission shall employ a secretary and. treasurer (who may or may not be
a member of the commission) and if not a member of the commission,
fix his compensation and duties. Any members of the commission may be
removed from office by the Governor of the State of Virginia for cause.
Each member of the commission, immediately following his appointment,
shall take an oath of office, prescribed by section thirty-four (34) of the
Constitution of Virginia, before any judge of any court of record in this
State. The chairman and other members of the commission shall receive
such salaries as may be designated by the Governor; not to exceed in the
aggregate the sum of fifteen thousand dollars ($15,000.00) per annum;
and all such salaries and all compensation to the members of the com-
mission shall be paid from funds provided under the authority of this
act. Three (3) members of the commission shall constitute a quorum.
The records of the commission shall be public records. The commission is
authorized to do all things necessary or incidental to the performance of
its duties and the execution of its powers under this act.
