An Act to amend and reenact § 15-819 of the Code of Virginia, relating
to divisions or departments in certain counties, so as to permit the
establishment of a department of public utilities, and to amend the
Code by adding a section numbered 15-828.2, relating to such depart-
ment of public utilities.

Be it enacted by the General Assembly of Virginia:
1. That § 15-319 of the Code of Virginia be amended and reenacted,
and that the Code of Virginia be amended by adding a section numbered
15-328.2, the amended and new sections being as follows:
§ 15-319. The activities or functions of the county shall, with the
exceptions herein provided, be distributed among the following genera
divisions or departments:
CHS. 200, 201] ACTS OF ASSEMBLY
(1) Department of finance.
(2) Department of public works.
(3) Department of public welfare.
(4) Department of law enforcement.
(5) Department of education.
(6) Department of records.
(7) Department of health.
The board of county supervisors may establish any of the follow
additional departments and no others:
) Department of assessments.
(2) Department of farm and home demonstration.
(3) Department of public safety.
(4) Department of public utilities. .
Any activity which is unassigned by this form of county organizat
and government shall, upon recommendation of the county manager,
assigned by the board of county supervisors to the appropriate departm:
The board may further, upon recommendations of the county mana!
reassign, transfer or combine any county functions, activities or dep:
ments.
§ 15-828.2. The department of public utilities, if and when est
ished, shall be under the supervision of a director of public utilities
pointed by the county manager. Such department shall be in charge
the construction, operation, maintenance and administration of all pu
works coming under the general category of public utilities, owned, of
ated and controlled by any such county or any sanitary district of s
county, Such department shall be responsible for the administration
the affairs of the sanitary districts, including but not limited to wa
systems, sewer systems, sewage disposal systems, garbage and any ot
sanitary district functions not assigned or administered by other depc
ments. If the county has a division of fire protection and a fire chief un
the provisions of § 15-828.1 then such fire protection shall not be un
the department of public utilities.
