An Act to amend the Code of Virginia by adding a section numbered
15-7668 so as to provide for the vacation of certain easements.

Be it enacted by the General Assembly of Virginia: ;
1. That the Code of Virginia be amended by adding a section numbered
15-766.3 as follows:
§ 15-766.3. Any easement, or part thereof, not constituting a street,
alley, or passageway shown on a plat of subdivision or other plat, hereto-
fore or hereafter recorded, may be vacated with the consent of the gov-
erning body of the county, city or town in which the same is located, if
such vacation does not destroy or abridge any of the rights or privileges
of other property owners within the bounds of the area of land shown on
such plat or of any person, firm or corporation specifically designated as
the beneficiary of such easement on such plat or to whom the benefits
thereof have been granted by writing duly of record. Such vacation may
be by instrument in writing signed by all owners of properties on, over
or abutting which such easement is located, and any such beneficiary of
the easement or grantee of the benefits thereof, acknowledged in the
manner of a deed and filed for record in the clerk’s office of the court
wherein deeds are recorded of the county or city wherein the lands shown
on the plat are situated. ;
For the purpose of this section the word “owners” shall include lien
creditors.
