An Act for the relief of Earl R. Hudgins.

Whereas, heretofore one Herman Walker obtained an assignment of
certain oyster planting grounds located in the North River, such assign-
ment being based upon a survey made by the Commission of Fisheries, and
which assignment was subsequently assigned for value by said Herman
Walker to Earl R. Hudgins, of Hallieford, Virginia, and,
Whereas, Earl R. Hudgins, relying on such survey and the rights of
his predecessor in title paid license taxes to the Commission of Fisheries
and expended money for the purpose of planting the bottom of such
planting grounds with oyster shells in addition to the amount paid to
Herman Walker for such assignment, all in the amount of five hundred
and fifty dollars; and
Whereas, subsequent to such assignment and expenditures the exec-
utor of the estate of one P. M. Hicks caused a resurvey of such oyster
planting grounds to be made, which said resurvey established that six acres
of said oyster planting grounds were within the boundaries of certain
oyster planting grounds held by said P. M. Hicks and said executor, his
successor in title under a prior assignment from the Commission of Fish-
eries, thus defeating all rights Earl R. Hudgins had in such portion of
oyster planting grounds; and
Whereas, Earl R. Hudgins is without an adequate remedy at law to
compensate him for the damage he has sustained by reason of the negligent
survey upon which his assignment to such oyster planting grounds was
based; now, therefore,
Be it enacted by the General Assembly of Virginia:
1. There is hereby appropriated from the general fund of the State
Treasury the sum of three hundred dollars to be paid to Earl R.
Hudgins by check of the State Treasurer issued on warrant of the Comp-
ee drawn in pursuance of voucher signed by the Commissioner of
isheries.
