Whereas, in the summer of 1949 the State Department of Highways
was operating an asphalt plant in close proximity to the Odd Fellows’
Hall located at Olinger in Lee County, Virginia; and
Whereas, through the negligence of the agents and employees of the
State Department of Highways charged with the duty of operating said
plant, certain crude oil used in the operation thereof was suffered or per-
mitted to escape from its containers and enter and contaminate the well
supplying the said Odd Fellows Hall and certain living quarters therein
with water, rendering the water supplied by said well permanently un-
suitable for human use; and
Whereas, said B. P. Slemp, M. H. Reasor, N. R. Bartley, French
Sarvers and C. T. Slemp in their capacity as trustees for Willard Lodge
No. 106, International Order of Odd Fellows, were forced to expend from
the funds of said Willard Lodge No. 106, International Order of Odd
Fellows, the sum of three hundred twenty-seven dollars thirty-one cents
for the purpose of installing a suitable well on the premises of said Odd
Fellows Hall; and
Whereas, said Willard Lodge No. 106, International Order of Odd
Fellows, is without remedy at law for the loss it has sustained; now,
therefore,
Be it enacted by the General Assembly of Virginia:
1. There is hereby appropriated from the highway funds in the treasury
the sum of three hundred twenty-seven dollars thirty-one cents to be paid
jointly to B. P. Slemp, M. H. Reasor, N. R. Bartley, French Sarvers and
C. T. Slemp, trustees for Willard Lodge No. 106, International Order of
Odd Fellows by check of the State Treasurer issued on warrant of the
Comptroller drawn in pursuance of voucher signed by the State Highway
Commissioner.
