CHAPTER 349

An Act to amend and reenact § 38-111, as amended, of the Code of
Virginia, relating to the sale of materials by the State Highway
Commission to cities, towns, counties and school boards.
Be it enacted by the General Assembly of Virginia:

1. That § 33-111, as amended, of the Code of Virginia be amended and
reenacted as follows:

§ 33-111. The Commission may lend or rent equipment and sell
materials and supplies used in the building or repairing of roads and
streets to any city, town, county, or school board, upon such terms and
conditions as may be agreed upon by the Commission and such city, town,
county, or school board. Provided the governing body of such city, town,
county, or school board submits to the Commission a certificate setting
forth that the material or equipment cannot be furnished from private
sources within a reasonable time. Provided further that the foregoing
proviso shall not apply to towns with a population of less than thirty-five
hundred inhabitants.
