An Act to amend and reenact § 46-808 of the Code of Virginia, relating
to the manner of fastening certain loads on certain vehicles. | 128]

Be it enacted by the General Assembly of Virginia:
En That § 46-308 of the Code of Virginia be amended and reenacted as
ollows:
§ 46-308. No vehicle which is designed or used for the purpose of
hauling logs, poles or lumber, barrels, hogsheads or other materials or
containers which by their very nature may shift or roll, shall be operated
or moved over any highway unless its load is securely fastened by chain
or metal cable so as to prevent the shifting, or falling of such load from
the vehicle, provided, however, that tobacco hogsheads may, in lieu of
chains or metal cables, be secured by manila or hemp rope of such
strength as to securely fasten the hogshead against shifting, falling, or
rolling, and in any case of not less than five-eighths inch in diameter.
But nothing in this section shall be construed to release the owner
or operator from liability for failure to use reasonable care in securing
or fastening said load from shifting or falling. |
