An Act to amend and reenact §§ 9, as amended, and 10 of Chap 308
of the Acts of Assembly of 1944, approved March 29, 1944, relating
to a system of pensions and retirement for the benefit of the personnel
of police departments of certain counties, and to repeal § 4 thereof.

Be it enacted by the General Assembly of Virginia:
1. That §§ 9, as amended, and 10 of Chapter 303 of the Acts of
Assembly of 1944, approved March 29, 1944, be amended and reenacted
as follows:
§ 9. Should any such policeman die while in active service, leaving
no dependents, his salary deductions shall remain in the policemen’s pen-
sion and retirement fund. Should any such policeman, who shall have been
separated from the service on or after July. one, nineteen hundred fifty-
one and whose employment shall have been terminated otherwise than by
death or retirement, he shall, on application made within two years from
the date of such separation, be refunded * all of his accumulated contri-
butions; provided, however, that if such policeman has received payments
or benefits under this system, the amount of such payments or benefits shall
be deducted from the amount to be refunded.
§ 10. For the purpose of raising funds for the payment of pensions
and benefits and the costs and expenses of administering the affairs of the
board there shall be levied monthly, and deducted from the salaries of
the policemen, * five per centum of the amounts of their salaries and all
such amounts so levied and deducted shall be paid into the treasury of the
board. The county board shall contribute to the pension fund an amount
at least equal to the amount contributed by the policemen.
2. § 4 of Chapter 303, as amended, of the Acts of Assembly of 1944, ap-
proved March 29, 1944, is repealed.
3. An emergency exists and this act is in force from its passage.
