An Act for the relief of the Crown Savings Bank.

Whereas, the Crown Savings Bank, on the ninth of August, 1951,
did lend the sum of fifteen hundred dollars to a certain M. S. Harrelson of
Newport News, Virginia, for which loan security was taken in the form
of the title to a new automobile, though possession remained in Harrelson ;

Whereas, the lien upon the automobile was duly recorded upon the
title to the automobile with the Division of Motor Vehicles of the State
of Virginia, and registered with them; and
Whereas, on or about the thirtieth day of January, 1951, a title to
the same automobile was issued to a certain Buster Terry, of Newport
News, Virginia, he being the true owner of the automobile; and
Whereas, M. S. Harrelson is insolvent, and confined in the Eastern
State Hospital at Williamsburg, Virginia, and is also under indictment
in the Corporation Court of the city of Newport News, Virginia; and
Whereas, but for the negligence of the Division of Motor Vehicles,
the title would not have been issued to Harrelson, and the loss by the
Crown Savings Bank in the sum of one thousand four hundred ninety-one
dollars and fifty cents would not have occurred; the Crown Savings Bank
having relied upon the title issued by the Division of Motor Vehicles of
the State of Virginia; and
Whereas, inasmuch as the Division of Motor Vehicles is an agency
of the State, and there is no means by which the Crown Savings Bank
may recover its loss; Now, Therefore,
Be it enacted by the General Assembly of Virginia:
1. That there is hereby appropriated to the Crown Savings Bank the
sum of one thousand four hundred ninety-one dollars and fifty cents, the
same to be paid it by the State Treasurer on the warrant of the Comptroller
from fees collected by the Division of Motor Vehicles for the registration
and licensing of vehicles and paid into the State Treasury.
Simultaneously with the delivery of the warrant, the Crown Savings
Bank shall execute a full and complete release to the Commonwealth of
Virginia in satisfaction of the matter hereinabove mentioned, together
with a written agreement in proper form agreeing that the Crown Savings
Bank will refund to the Division of Motor Vehicles any sum or sums it may
recover from any other source on this claim, not exceeding the amount
hereunder paid to it.
