An Act for the relief of McKinley Manns.

Whereas, in September, 1951, several convicts escaped from the State
convict road force near Horse Pasture in Henry County and several guards
employed by the State at such camp were endeavoring to apprehend the
escaped convicts; and
Whereas, R. G. Ball and Willie DeFreeze, among several other State
guards, having information that the escaped convicts were to pass along
a certain portion of the State highway, secreted themselves along the high-
way at night; and
Whereas, McKinley Manns, a citizen in good standing, was walking
along this highway between ten and eleven P. M. as he had a right to do
when one of the guards cried out at him to stop, which said Manns so did,
whereupon one of the guards fired and said Manns attempted to flee; and
’ Whereas, in lawful flight said Manns was struck by shots fired by
such guards and seriously wounded as a result of which he incurred
hospital bills in the amount of three hundred eight dollars and fifty cents,
lost wages in the amount of three hundred eighty-one dollars and sixty
cents, suffered extreme pain and anguish and will always have an impair-
ment in his walk; and
Whereas, McKinley Manns is without remedy at law and in equity
to obtain redress for the losses and suffering which he has incurred; now,
therefore, ;
Be it enacted by the General Assembly of Virginia: —
1. There is hereby appropriated the sum of fifteen hundred dollars
from the special funds in the State Treasury for the support and main-
tenance of the said convict road force to be paid to McKinley Manns by
check of the State Treasurer, issued on warrants drawn by the Comp-
troller, prepared in accordance with vouchers signed by the State High-
way Commissioner.
