An Act to require the setting aside of oyster shell; to provide for the
disposition thereof; and to provide for the payment therefor.

Be it enacted by the General Assembly of Virginia:
1. § 1. Each shucker or packer of oysters shall set aside at least
twenty per centum of the shells therefrom for sale to the Commission at
the prevailing market price.
§ 2. On or before December one of each year the Commission shall
notify each shucker or packer whether it will purchase by June one fol-
lowing the shells so set aside. If such notice be not given the shucker or
packer may dispose of such shells as he sees fit, provided, if such shucker
or packer file affidavit with the Commission of Fisheries prior to December
one that all of his shells will be planted on oyster planting ground leased
to such shucker or packer in Virginia during the ensuing year, the Com-
mission may relieve such shucker or packer from compliance with the
provisions of this act.
§ 3. From funds provided by law the Commission shall pay the
owner of the shells for the amount so taken. Shells bought hereunder
shall be planted by the Commission at such places as it deems proper.
