CHAPTER 559
An Act to amend and reenact §§ 19-11 and 19-29, as amended, of the
Code of Virginia; and to amend the Code by adding a section num-
bered 18-805.1, the amended and new sections relating to forfeiture
of certain drugs possessed or used in violation of law, property used
in connection with such violation, enforcement of such forfeitures
and search warrants in connection therewith. rH 266)

Be it enacted by the General Assembly of Virginia:
1. That §§ 19-11 and 19-29, as amended, of the Code of Virginia, be
amended and reenacted, and that the Code be amended by adding a section
numbered 18-305.1, as follows:
§ 18-805.1. All cannabis, coca leaves, heroin, cocaine, opium, mor-
phine, or laudanum, or any compound, manufacture, mixture, salt, deriva-
tive or preparation thereof; or any synthetic substitute for cannabis,
coca leaves, heroin, cocaine, opium, morphine, or laudanum, or any com-
pound, manufacture, mixture, salt, derivative or preparation thereof, used
in violation of § 18-805 of the Code of Virginia or §§ 54-487 to 54-519, in-
nclusive, of the Code, known as the “Uniform Narcotic Drug Act’’, or
found in the possession of any person contrary to the “Uniform Narcotic
Drug Act” ; and all money, medical equipment, office equipment, laboratory
equipment and all other personal property of any kind or character, used
m connection with the use or possession of such drugs in violation of law,
shall be forfeited to the Commonwealth and may be seized by an officer to
be disposed of as provided by law.
§ 19-11. Any forfeiture incurred by a violation of §§ 18-284, 18-301,
or 18-302 or in accordance with § 18-805.1 may be enforced under chapter
10 of Title 29 in like manner as a forfeiture may be enforced thereunder
for violation of any of the provisions of Titles 28 and 29, except as follows:
(1) § 29-220 and so much of § 29-224 as relates to § 29-220, shall
not apply to the case;
(2) There shall be no publication of the notice in a newspaper as
required by § 29-219;
(3) If the forfeiture was incurred within the jurisdictional limits of
a corporation having a corporation or hustings court, the information
shall be filed in such court and the notice posted at the front door of the
courthouse of said corporation ;
(4) Any money, condemned as forfeited, shall not be sold, but shall
be disposed of by the court in like manner as the proceeds of forfeited
property condemned and sold; and
(5) If the property seized pursuant to § 18-302 of the Code of Vir-
ginia be a motor vehicle or vehicles, then the proceeding for forfeiture of
any such motor vehicle or vehicles shall be brought in accordance with
the provisions of § 4-56 of the Code of Virginia and the rights of inno-
cent owners and lienors of said motor vehicle or vehicles shall be protected
as provided in said § 4-56 of the Code of Virginia, and the provisions of
that section as to innocent owners and lienors shall be applied.
§ 19-29. On like complaint, on oath, according to the nature of the
case, supported by the affidavit required by § 19-30, such justice or judge
whom it is made, if satisfied that there is reasonable cause therefor,
shall issue a warrant to search specified places for the following things:
(1) Counterfeit or spurious coin, forged bank notes, and other instru-
ments or writings, or any tools, machines or materials for making them;
_ (2). Any book or other thing containing obscene language, or any
print, picture, figure, or description manifestly tending to corrupt the
morals of youth, and intended to be sold, loaned, circulated, or distributed,
or to be introduced into a family, school or place of education;
(3) Lottery tickets, or materials unlawfully made, provided or pro-
cured for drawing a lottery;
(4) Any gaming apparatus or implements used, or kept and provided
to be used, in unlawful gaming or in any place resorted to for unlawful
gaming ;
(5) Weapons or other objects used in the commission of a crime;
(6) Any cannabis, coca leaves, heroin, cocaine, opium, morphine, or
laudanum, or any compound, manufacture, mixture, salt, derivative or prep-
aration thereof, or any synthetic substitute for cannabis, coca leaves, heroin,
cocaine, opium, morphine, or laudanum, or any compound, manufacture,
mixture, salt, derivative or preparation thereof, used or possessed in viola-
tion of § 18-805.1 or §§ 54-487 to 54-519, inclusive, of the Code of Virginia.
