An Act to amend and reenact §§ 42-24, 42-25, 42-26, 42-27, 42-29, 42-30
and 42-32 of the Code of Virginia, relating to State aid for certain
libraries and the terms, conditions and limitations thereon; and to add
anew section to the Code of Virginia numbered 42-26.1, relating to the
same subject.

Be it enacted by the General Assembly of Virginia:
1. That §§ 42-24, 42-25, 42-26, 42-27, 42-29, 42-30 and 42-32 of the
Code of Virginia be amended and reenacted, and to add a new section,
designated as 42-26.1, to the Code of Virginia, as follows:
§ 42-24. Grants for development.—In order to provide State aid in
the development of public library service throughout the State, particu-
larly in rural communities, the Library Board, in this chapter sometimes
called the Board, shall grant from such appropriations as are made for this
purpose funds to provide * library service to county and regional free
library systems, established pursuant to the provisions of §§ 42-4 and 42-5.
§ 42-25. Limitations on such grants.—Original grants shall be limited
to * not more than one dollar per capita of * the county or region as shown
by the last preceding United States Census * and in no case to exceed
thirty-five thousand * dollars *. Such grants shall be made to areas
approved by the State Library Board under standards fixed by it. Not
more than one library in a county or regional free library system shall re-
ceive aid under this chapter, and such library shall serve as an administra-
tive center for county or regional free library service to the whole county
or region; provided that in the case of a contract with an adjacent library
for county or regional free library service as provided in §§ 42-8 and
42-12, such aid shall be given to the library contracting to give such
service, which library shall then be the administrative center for a county
or regional free library system. * Original grants may be expended for
a stated period under the direct authority of the State Library Board under
standards and requirements established by the Board.
§ 42-26. Grants to improve standards.—In order to encourage the
maintenance and development of proper standards, including * personnel
standards, and the combination of library systems or libraries into larger
and more economical units of service, grants of State aid may be made by
the Board to any qualifying library system or qualifying library, estab-
lished in any prior State fiscal year, which lacks the prescribed ratio of
books per capita. Such grants * shall be limited to matching at the ratio
of * twenty-five cents of State aid to one dollar of local funds expended
or to be expended, exclusive of State funds, by * county libraries serving
less than thirty-five thousand population up to a maximum of fifteen
hundred dollars of State aid; and at the ratio thirty-five cents of State aid
to one dollar of local funds expended or to be expended, exclusive of State
funds, by a regional library or a county library serving over thirty-five
thousand population up to a maximum of fifteen thousand dollars of
State aid. There may be provided in excess of the maxima above estab-
lished State aid for county and regional libraries or library systems up to
an additional twenty cents for each one dollar of increase in local funds
expended or to be expended during the current fiscal year over the fiscal
year immediately preceding. Municipal libraries serving less than five
thousand population may receive in State aid direct loans of books from
the State Library or a minimum of two hundred dollars; municipal libra-
ries serving over five thousand population may receive in State aid ten
cents for each one dollar of local funds up to a maximum of one thousand
dollars for libraries serving between ten thousand and thirty-five thousand
population and a maximum of five thousand dollars for libraries serving
over thirty-five thousand population. Any such previously established
library system or library, contracting for library service as provided in
Chapters 1 and 2 of this title may qualify separately for State aid as pro-
vided herein.
§ 42-26.1. If the State appropriations provided for grants under §§
42-24, 42-25 and 42-26 are not sufficient to meet approved applications, the
Library Board shall prorate the available funds in such manner that each
application shall receive its proportionate share. Applications.must be
received prior to September 1 of each calendar year.
§ 42-27. Obligations of libraries and systems receiving aid.—The
obligations of the various library systems and libraries receiving State aid,
shall consist in establishing and maintaining an organization as approved
by the Board; * provided that personnel standards of such library systems
and libraries shall conform to the provisions of Chapter 11 of Title 54 for
the certification of librarians, and with rules and regulations prescribed by
the State Board for the Certification of Librarians in accordance with such
chapter. All books and bookmobiles purchased with State aid funds shall,
if the Board so determines, become the property of the State Library in
the case of any library system or library whieh does not meet its obliga-
tions as determined by the Board.
§ 42-29. Expense of administration.—Not to exceed ten per cent per
annum of appropriations may be used by the Board to defray the expense
of administering the provisions of this chapter and to provide other public
library extension functions.
§ 42-30. Procedure for purchase of books and bookmobiles and pay-
ment on salaries.—All proposals for books and bookmobiles to be purchased
with State aid funds and all proposals for aid in the payment of salaries
of certified librarians shall be submitted for approval to the State Library
by the libraries, library systems or contracting libraries applying for State
aid, in form prescribed by the Board, and those approved may be ordered
by the libraries, library systems or contracting libraries, which shall, after
receipt, certify the invoices of such books and bookmobiles and payment on
salaries to the State Library with bills for same rendered to the State
Library. Payments and disbursements from the funds appropriated for
this purpose shall be made by the State Treasurer upon warrants of the
Comptroller issued upon vouchers signed by the duly authorized repre-
sentative of the Board. The Board shall act to obtain the best prices and
most advantageous arrangements in securing all books and bookmobiles
purchased through State aid.
§ 42-32. Meaning of term ‘“books’.—The term “books” as used in
this chapter may be interpreted in the discretion of the Board to mean
books, magazines, newspapers, appropriate audio-visual materials and
other printed matter.
