An Act to amend and reenact § 4-58 of the Code of Virginia relating to
illegal sales of alcoholic beverages.

Be it enacted by the General Assembly of Virginia:
1. That § 4-58 of the Code of Virginia be amended and reenacted as fol-
lows:
§ 4-58. * If any person who is not licensed under the provisions of this
chapter to sell alcoholic beverages in this State shall sell any alcoholic
beverages other than permitted by the provisions of this chapter, he shall
be * guilty of a misdemeanor. :
(b) The punishment for any violation of the provisions of this section
shall be a fine of not less than fifty dollars nor more than five hundred
dollars and confinement in jail for not less than thirty days nor more than
twelve months; and the justice, mayor or court, before whom any person
is convicted for the violation of this section, may require such persons to
give bond as is provided in § 4-92, subsection (b). Provided, however,
that in the event of a second or subsequent conviction under this section
the jail sentence so imposed shall in no case be suspended.
The justice, trial justice, mayor or other court before whom any per-
son is convicted for the violation of this section may require such person
to give bond as is provided in § 4-92, subsection (b).
