An Act to amend and reenact § 33-107 of the Code of 1950, relating to the
filing of a claim as a prerequisite to suit against the Department of
Highways, and limitations on such suits. g

Be it enacted by the General Assembly of Virginia:
1. That § 33-107 of the Code of 1950 be amended and reenacted as
follows:
§ 33-107. Filing claim prerequisite to suit; limitation.—No claim aris-
ing from the prosecution of the project by the contractor shall be main-
tained against the Commonwealth of Virginia unless such claim shall have
been filed at the office of the Department of Highways, at Richmond, Vir-
ginia, within ninety days after the completion of the work thereunder
to the satisfaction of the chief engineer. The failure to file any such claim
heretofore or hereafter arising within the period herein provided shall
not affect any right of action against the contractor or his surety.
Suit or action against the Commonwealth must be brought * within
one year after * completion of the work on the project * and as against
the contractor or surety, suit or action must be brought within five years
after completion of the work on the project.
