An Act to give the consent of the State of Virginia to such individuals or
company as may be granted a site or sites, leases and privileges by
the Secretary of the Army of the United States to construct, maintain
and operate permanent type rental housing facilities and buildings on
the Fort Monroe Military Reservation at Fort Monroe, Meo 389)

WHEREAS, pursuant to Act of the General Assembly of Virginia,
passed on the ist day of March in the year eighteen hundred and twenty-
one, David Campbell, Governor of the Commonwealth of Virginia, did
by deed under the seal of the Commonwealth grant and convey to the
United States of America certain lands and shoals at Old Point Comfort,
Virginia, in said deed fully described upon terms and conditions also in
said deed, as set forth; and
WHEREAS, by said deed it is, among other things, provided “that the
United States shall use the said land for purposes of fortification and na-
tional defense, and no other, and if the United States at any time abandon
said lands and shoals or appropriate it to any other purposes than those
herein mentioned, then this conveyance to be void and the said lands and
shoals to revert and revest in the Commonwealth of Virginia”; and
WHEREAS, there is an acute shortage of housing which now exists at
or in the area adjacent to the Fort Monroe Military Reservation and to
increase the supply of rental housing accommodations available to the
military and civilian personnel at the Fort Monroe Military Reservation,
the Congress of the United States has provided and granted to the Secre-
tary of the Army authority to lease real estate owned by the Government
of the United States to private persons for a period of 99 years, renewable
for an additional period of 99 years or less, or to lease property owned by
the Government of the United States for a period of not less than 50 years,
to run from the date a mortgage on said real estate is executed, said
mortgage being determined to be in the class of first liens, as are com-
monly given to secure advances on the unpaid purchase price of real
estate, under the laws of the state in which the real estate is located to-
gether with the credit instruments, if any, secured thereby, said lease and
first mortgage to be executed by a private person or private corporation as
distinguished from a governmental agency or corporation; and
WHEREAS, the Fort Monroe Military Reservation is determined to be
a permanent part of the military establishment of the United States; and
WHEREAS, the Public feels a great need for an extension and increase
of the permanent type of housing located on the Fort Monroe Military
Reservation to further secure the permanency of said military establish-
ment and to assist in the enlargement of said military establishment and
the activities at said installation; and
WHEREAS, the United States of America will grant no site or rights
to any corporation or individual for the construction or operation of any
type of permanent rental housing upon any portion of said land until
the consent of the Commonwealth of Virginia has been obtained there-
for, in order to avoid any possibility of the land so granted for perma-
nent types of rental housing reverting to or revesting in the Commonwealth
of Virginia;
Now, THEREFORE, be it enacted by the General Assembly of Virginia,
that:
1. Theconsent of the State of Virginia is hereby given to such individuals
or company and their successors and assigns aS may be granted a site
or sites, leases and privileges by the Secretary of the Army of the United
States to construct, maintain and operate permanent type rental housing
facilities and buildings on the Fort Monroe Military Reservation at Fort
Monroe, Virginia, for the term of 99 years or less from the date of such
grant, together with the privilege of renewing the same in case such
renewal be granted by the said Secretary of the Army for a further period
of 99 years or less from the expiration thereof, hereby abridging and
suspending the period of such grant the aforesaid provision of the deed
from the Commonwealth of Virginia to the United States by which such
site or sites may, might, or could revert or revest in the Commonwealth of
Virginia because of the same being used for other purposes than fortifica-
tion or national defense; provided, however, that the real property acquired
and held by such individuals or company and their successors and assigns
to construct, maintain and operate permanent type rental housing facil-
ities and the buildings and improvements placed thereon shall be liable
to such taxes, State and local, to the same extent as other real property
situate in the State during the term of the aforesaid grant or the ex-
tension thereof.
2. An emergency exists and this act shall be in force from its passage.
