CHAPTER 205
An Act to amend and reenact §§ 65-48 and 65-49 of the Code of Virginia,
relating to notification of employers by employees in cases of occu-
pational diseases covered by the Virginia Workmen’s Compensation
Act and to when claims in such cases shall be barred.
Be it enacted by the General Assembly of Virginia:
1. That §§ 65-48 and 65-49 of the Code of Virginia be amended and
reenacted as follows:
§ 65-48. Within thirty days after * the employee first experiences a
distinct manifestation of an occupational disease in the form of symptoms
reasonably sufficient to apprise him that he has contracted the disease, or
a diagnosis * of such disease is first communicated to him, whichever shall
first occur, * he or someone on his behalf, shall give written notice thereof
to the employer in accordance with §§ 65-82 and 65-83. The limitations
imposed by this section as amended shall be applicable to occupational dis-
eases contracted before and after the effective date hereof.
65-49. The right to compensation under this chapter shall be
forever barred unless a claim be filed with the Industrial Commission
within one year after the * employee first experiences a distinct mani-
festation * of an occupational disease in the form of symptoms reasonably
sufficient to apprise him that he has contracted the disease, or a diagnosis
* of such disease is first communicated to him, whichever shall first occur *;
and, if death results from the occupational disease within said one year
period, unless a claim therefor be filed with the Commission within one
year * after such death. The limitations imposed by this section as amended
shall be applicable to occupational diseases contracted before and after
the effective date hereof.
