An Act to amend and reenact § 1014 of Chapter 41 of the Acts of Assembly
of 1938, approved March 1, 1988, being the charter of the town of
Appalachia, Virginia, the section relating to the appointment of jus-
tices and substitutes.

Be it enacted by the General Assembly of Virginia:
1. That § 1014 of Chapter 41 of the Acts of Assembly of 1938, approved
March 1, 1938, be amended and reenacted as follows:
§ 1014. The council, in its discretion, may appoint a justice of the
peace, or police justice and a substitute justice of the peace or police
justice for the town of Appalachia, who, when acting in such capacity,
shall have power and authority and jurisdiction to try violations of
all ordinances of the said town, and who shall be clothed with all the
powers and authority in both civil and criminal matters within said town
as is now conferred upon the mayor of towns in Virginia by the general
laws of this Commonwealth. When such appointment is made, the mayor
thereof shall by virtue of his office possess no power, authority or juris-
diction to try violations of the ordinances of said town or to act as justice
of the peace or police justice in either civil or criminal matters, and shall
only receive a salary such as is provided for councilmen.
The said justice of the peace or police justice and the substitute shall
serve at the pleasure of the council, who shall fix * the salary of the justice
of the peace or police justice at a sum not exceeding seventy-five dollars
($75.00) per month. The compensation of the suodstitute justice of the
peace or police justice shall be fixed by the council in a sum not to exceed
the salary of the justice of the peace or police justice and may deduct such
sum, or any part thereof, from the salary of the justice of the peace or
police justice when they shall deem it proper to do so.
The substitute justice shall act in the event of the inability of the
justice of the peace or police justice to perform the duties of his office
by reason of sickness, absence, vacation, interest in the claim, proceedings
or parties before his court or otherwise and at such other times as the
council may prescribe, and when so acting he shall be vested with the
power, authority and jurisdiction herein conferred. All charges, costs,
and fees taxable and collectible by the justice of the peace or police justice
or substitute in the trial of all cases, civil and criminal, when taxed and
collected, shall be paid into the treasury of the town and the said justice
shall have no personal financial interest therein.
2. Anemergency exists and this act is in force from its passage.
