An Act to prohibit the dredging for oysters in the James River at certain
times; to provide exceptions thereto and the conditions thereof; to
prohibit certain acts and provide penalties for violations.

Be it enacted by the General Assembly of Virginia:
1. § 1. It shall be unlawful for any person to dredge for oysters in the
James River during the open season for taking oysters from the public
rocks and shoals; provided, however, that the Commission of Fisheries
may grant a permit to applicants therefor to dredge in specified areas
which permit shall be valid only within the ten days following its issuance.
It shall be unlawful for any person heretofore given a permit, to dredge
for oysters in such river after the expiration of such permit.
§ 2. Any person violating any provisions of this act shall be guilty
of a misdemeanor and punished as provided by law. In addition the dredge
and equipment used in violation thereof shall be subject to confiscation
under the procedure set forth in Title 28 of the Code of Virginia.
