CHAPTER 74
AN ACT to amend and reenact § 2, as amended, of Chapter 396 of
the Acts of Assembly of 1899-1900, approved February 17, 1900,
which chapter provided a new charter for the town of Smith-
field, the section relating to officers of the town and salary of
the mayor, so as to remove limitations applicable to certain
officers and to raise the marimum salary that may be paid
the mayor; and to validate certain actions.

Be it enacted by the General Assembly of Virginia:
1. That section two, as amended, of Chapter three hundred nine-
ty-six of the Acts of Asembly of eighteen hundred ninety-nine—
nineteen hundred, approved February seventeen, nineteen hundred
be amended and reenacted as follows:
§ 2. The officers of the said town shall consist of a mayor, six
councilmen, a sergeant, a treasurer, and such other officers as the
council may appoint, who with the erception of the sergeant, shall
be citizens and qualified voters of the said town.
The mayor, councilmen, and sergeant, shall have all the power
and authority conferred on such officers by the forty-fourth and
one hundred and ninety-first chapters of the Code of Virginia, of
the edition of eighteen hundred and eighty-seven, by all acts
amendatory thereto, and by all laws applicable to towns and such
officers.
In the event of the death, sickness, or absence of the mayor,
any and all of the powers, duties, and authority may be exercised
by any of the councilmen of the town destgnated by the council
from its membership either as president pro tempore or for a
longer pertod until a new mayor is elected or appointed under thir
charter.
The salary of the mayor shall not exceed * siz hundred dollars
per year, and the councilmen shall serve without compensation.

-. The prior amendment of this section is validated and all ac-
tions thereunder are hereby validated.
3. All payments to the mayor since October one, nineteen hundred
forty-nine at the rate prescribed by this section as amended hereby
are validated and confirmed.
4. An emergency exists and this act is in force from its passage.
