CHAPTER 72
AN ACT to amend and reenact § 1 of Chapter 98 of the Acts of
Assembly of 1940, approved February 27, 1940, relating to the
creation of mosquito control districts, so as to make the same
applicable to all countics and cities of the State.

Be it enacted by the General Assembly of Virginia:
1. That § 1 of chapter ninety-eight of the Acts of Assembly of
nineteen hundred forty, approved February twenty-seven, nineteen
hundred forty, be amended and reenacted as follows:
§ 1. The board of supervisors or other governing body of each
* county, either alone or jointly with one or more * other counties,
may create one or more mosquito control districts in such county
or counties, no part of which shall include the territory within an
incorporated city or town within any such county except by agree-
ment with such city or town as hereinafter provided. The * govern-
ing body of each * city, either alone or jointly with one or more *
other cities, may create one or more mosquito control districts in
such city or cities, to comprise the whole or any part of such city
or cities. For any town, * the council of such town may create one
or more mosquito control districts to comprise the whole or any
part of such town.
By agreement between any county and any city, or between
any county and any town, or between any city and any town. *
one or more mosquito control digtricts may be created to comprise
territory within such county, city or town, and such agreement
may be entered into between the governing bodies of two or more
such political subdivisions of the State of Virginia.
